The purpose of this amendment is outlined below: Answer all questions received by the 2/10/2023 11:00AM EST deadline. Questions and answers are as follows: Q: Can the due date be extended? A: The due date will not be extended. Q: A company is a small business but not an SDVOSB, and they are the sole source for some of the items being solicited. Should the company submit an offer on this solicitation stating that they are the sole source and provide OEM letters as support? Or will the items not be able to be quoted on by small businesses for this solicitation? And will these items be requested in a later solicitation that is open to all small businesses, and should small businesses wait to respond to that opportunity? A: This opportunity is open to businesses of all sizes using a tiered evaluation approach. Please see RFQ provision 52.212-2 Evaluation-Commercial Items under section E.3. Q: Is there a non-manufacturer rule waiver for this requirement? A: There is not a standalone non-manufacturer rule (NMR) waiver approved for this requirement, however, NMR Class waivers do apply to this requirement. H146--Hach Water Quality Monitoring Service
Solicitation # 36C24127Q0031
The Department of Veterans Affairs Networking Contracting Office intends to enter into a sole source procurement with Hach Company under FAR 6.302-1 for water quality monitoring services at the VA Medical Center in White River Junction, Vermont. This requirement is designated under NAICS code 811310. The scope of work involves the inspection, maintenance, repair, and annual calibration of ten Hach water quality monitoring instruments located across several facility buildings, as well as the annual calibration of one colorimeter. The contract includes two scheduled visits per 12-month period, 24/7 emergency service, and monthly reagent refills. These services are critical for ensuring the supply of safe drinking water and generating the daily data reports required by the State of Vermont Drinking Water Protection Division. The procurement is awarded to Hach Company because the equipment and services are proprietary, and the manufacturer does not authorize other organizations to perform repairs or recalibrations. Because the work is performed within a functioning hospital, the contractor must adhere to strict infection control practices and submit an Infection Control Plan, Activity Hazard Analysis, and Material Safety Data Sheets for approval. All work must comply with NFPA, OSHA, EPA, and specific VA specifications and handbooks. The government retains all rights to data and electronic records produced under the contract, and the contractor must comply with the Privacy Act of 1974 and the Freedom of Information Act. Interested parties must submit their capabilities to Kenya Mitchell by the specified deadline to determine if competitive procedures are feasible.
