NON-MANUFACTURER RULE (NMR) REQUIREMENTS: Vendors responding must identify whether they qualify as a non-manufacturer under FAR 19.102(f) and 13 C.F.R. 121.406. If not the manufacturer, the vendor must: 1. Be primarily engaged in retail or wholesale trade. 2. Take ownership or possession of the item(s) with their own personnel, equipment, or facilities. 3. Supply the product of a small business manufacturer unless a waiver applies. 4. Identify the manufacturer, size status, and compliance with NMR.
BUY AMERICAN ACT (BAA) & TRADE AGREEMENTS ACT (TAA) REQUIREMENTS: Products offered must comply with FAR 52.225-1 (Buy American), FAR 52.225-3/4 (Free Trade Agreements), or FAR 52.225-5 (TAA), as applicable. Respondents must provide: 1. Country of origin for each item. 2. Whether the item is a domestic end product under BAA. 3. Confirmation of TAA compliance if applicable. 4. Confirmation that supporting documentation is available upon request.

NOTES: Issuance of this notice does not constitute any obligation whatsoever on the part of the Government to procure these supplies and/or services, or to issue a solicitation, nor to notify respondents of the results of this notice. No solicitation documents exists at this time; however, in the event the acquisition strategy demonstrates that GSA is a viable option for procuring a solution, the RFQ shall be posted to GSA eBuy where only those firms who currently hold a GSA Schedule with the applicable SIN will be able to respond. The Department of Veterans Affairs is neither seeking quotes nor accepting unsolicited quotes, and responses to this notice cannot be accepted as offers. Any information the vendor considers proprietary should be clearly marked as such. The U.S. Government will not pay for any information or administrative costs incurred in response to this Sources Sought notice.
