The Immigration and Customs Enforcement Division of Homeland Security plans to award a sole source purchase order to NS Microwave for high-performance day/night camera concealments and related accessories. NS Microwave, located in Staten Island, NY, is the proprietary designer of these camera systems, which feature unique engineering, circuits, controllers, and pedestals. These enhancements make NS Microwave the exclusive service provider for these cameras, as no other vendor or manufacturer can service or supply components compatible with the existing systems. This exclusive capability is necessary for ICE to maintain system continuity and ensure compatibility with its current camera operations. The award is anticipated around September 5, 2006, and responses from other interested parties are being solicited solely to determine whether a competitive procurement should be conducted, although any decision to forego competition remains at ICE’s discretion. NS Microwave’s camera systems are tailored to operate at specific standards, frequencies, and settings proprietary to their designs, which are not available on the open market. The notice of intent allows for submission of interest by September 4, 2006, but explicitly clarifies that responses will not be considered proposals or bids, nor will cost or pricing data be requested. The procurement falls under NAICS code 443130, and the agency’s designated contract specialist for this procurement is Tracy C Miller, reachable via email or phone for inquiries. This sole source acquisition is justified under the authority of FAR 6.302, emphasizing proprietary rights and the necessity for system compatibility in ICE’s operational requirements.
