The Department of Defense's Joint Communications Support Element (JCSE) intends to award a sole source contract for the continued maintenance support of 20 Promina Digital Network Exchange Systems, which are specifically designed and provided by Network Equipment Technologies (N.E.T.) Federal. This contract includes access to a Technical Assistance Center with 24/7 phone support, software upgrades, and next business day hardware replacement. N.E.T. Federal is the exclusive manufacturer and authorized distributor, while CACI is the sole authorized service provider for these systems. Any interested parties were invited to express their interest or submit proposals by September 3, 2007, although the government reserves the right to proceed without competition, based on their discretion. The justification for the sole source award is based on the unique qualifications of N.E.T. Federal and the specialized nature of the Promina systems, which were custom-designed and configured to meet JCSE’s specific requirements for wide area network services. Replacing these systems would involve significant cost and operational impacts, including forfeiture of a $9 million investment, procurement expenses, implementation delays, and retraining efforts, making competition cost-ineffective and impractical. The contract is subject to the availability of appropriated funds, meaning the government’s payment obligations hinge on the allocation of the necessary budget before contract execution.

THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. This is a notice of intent to award a sole source contract under statutory authority 10 USC 2304(c)(1), set forth in Federal Acquisition Regulation 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The Joint Communications Support Element (JCSE) requires the continued maintenance support services of 20 Promina Digital Network Exchange Systems. The maintenance support services includes access to the Technical Assistance Center (TAC), 24 hours a day / 7 days a week phone support, software upgrades, and next business day hardware replacement. Promina Digital Network Exchange Systems are exclusively designed, developed, and fielded solely by Network Equipment Technologies (N.E.T.) Federal. N.E.T. Federal is the only authorized distributor and CACI is the only authorized provider of the services required to support and maintain these systems. Any interested parties may e-mail contact@example.gov or fax +1 (555) 000-0000, Joyce Wright, no later than Monday, 3 September 2007, 4:00 p.m. EST. Per FAR Part 5.207-13(e) Fed Biz Ops Numbered Note 22 applies and is modified to read: 22. The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, all proposals received by Monday, 3 September 2007, 4:00 p.m. EST will be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. V. DEMONSTRATION THAT THE CONTRACTOR?S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY) The Promina Digital Network Exchange Systems were purchased from N.E.T. Federal. After systems were purchased N.E.T. Federal designed and configured a multi-service access platform to meet the specific needs of JCSE. The configuration provides an adaptive and reliable foundation for building Wide Area Networks (WANs) and interfacing with other carrier services. This allows for the consolidation of a variety of user traffic and applications on a single platform while supporting Time Division Multiplexing (TDM), Frame Relay, Integrated Services Digital Network (ISDN), Asynchronous Transfer Mode (ATM), and Internet Protocol (IP) Transport Techniques. To purchase another system would mean forfeiting a system currently valued at $9M and absorbing the costs and efforts (i.e., new system cost, time to employ new system, training of personnel, etc.) involved in procuring and implementing another system. It is not reasonable nor would it be cost effective to purchase another system when it too would require the same continued services. Substantial duplication of cost to the Government is not expected to be recovered through competition. NOTE: FAR Clause 52.232-18 -- Availability of Funds is in effect for this requirement. 52.232-18 -- Availability of Funds (Apr 1984) Funds are not presently available for this contract. The Governments obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer.
