The Government plans to award a sole source contract to Fishnet Security for the provision of Net Witness Security Analytics software, along with associated support and training services. This procurement is justified under FAR 6.302-1, indicating that Fishnet Security is the only responsible source capable of meeting the agency’s requirements, ensuring continuity of equipment and services. The contract follows provisions effective through Federal Acquisition Circular 2005-63 and adheres to the NAICS code 334613, which has a size standard of 1000 employees. Various federal acquisition clauses and deviations relevant to both commercial and defense contracting are incorporated to govern performance, compliance, reporting, and payment processes. The acquisition is not open to competition, but the Government invites interested parties with demonstrated capabilities to submit written information by August 30, 2013, for consideration regarding potential competitive procurement. The contract details reveal that the Department of Defense, specifically the USPFO Activity in San Miguel, California, is managing the award. The solicitation number is W912LA13T0029, and the contract provisions cover a wide range of regulatory requirements including small business preference programs, labor standards, prohibitions on trafficking, and Buy American Act compliance. Payment and administrative procedures also conform to electronic submission requirements. Responses to this sole source notice will help the Government decide whether to proceed with this non-competitive award or explore a competitive acquisition, though the final determination rests solely with the Government. All correspondence is directed to the USPFO Contracting Office in San Luis Obispo, California.
