The National Park Service in Yorktown, Virginia, plans to negotiate a sole source contract with York County, Virginia, for the purchase and programming of XTS 2500 Model 2 Portable Radios. This is a non-competitive procurement justified under Federal Acquisition Regulation 6.302-1(a)(2) because York County is uniquely qualified to provide the radios preprogrammed with the specific frequencies needed by the Park Law enforcement officers. York County leads the development of the Regional Radio System covering multiple jurisdictions, including Colonial National Historical Park, Williamsburg, and James City County, all of which require interoperable communications. The contract is being pursued under the authority of 41 U.S.C. 253(c)(1), allowing negotiation without competition due to the unique and critical requirements. The National Park Service emphasizes that only York County can meet these specialized technical needs within the established regional communication system. Interested parties are informed that this notice is not a request for competitive proposals and that the government retains sole discretion on competition. Questions or requests for additional information are to be directed to the designated contracting officer via email or fax within 30 days of the notice publication.
