This contract action was accomplished using other than competitive procedures because there is only one responsible source due to patent or data rights requirements, and no other supplies or services will satisfy agency requirements (FAR 6.302-1). See posted J&A for further information. The U.S. Army Space and Missile Defense Command/Army Forces Strategic Command negotiated and awarded, on a sole source basis, a modification to increase the ceiling of current contract W9113M-07-C-0161 with FLIR Systems, Inc, Wilsonville, Oregon. This action is pursuant to 10 U.S.C 2304(c) (1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirement. This action requires the original manufacturer of the StarSAFIRE III sensors to upgrade the Control Units of such sensors. The upgrade will provide the Control Units with Tracker and Laser Pointer functionality buttons. This action was awarded via a modification to the existing contract.
