A--NOTICE OF INTENT TO SOLE SOURCE

ERDC Contracting Office intends to solicit on a sole source basis under the authority of FAR 6.302-1 to Sporian Microsystems Inc., 515 Courtney Way Suite B, Lafayette, CO 80026-8821 for an Aqua-Path II Demonstration System with Buoys. This procurement is being conducted under Simplified Acquisition Procedures (SAP) only one responsible source and no other supplies or services will satisfy agency requirements. Sporian Microsystems Inc. is the only known source capable of meeting the Governments requirements due to the unique capabilities of the device. The Government intends to acquire a commercial item using FAR Part 12. Interested organizations may submit their capabilities and qualifications to provide the requirement in writing to the identified point of contact not later than 4:00 p.m. CST on 14 May 2010. Such capabilities/qualifications will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to compete this proposed effort on a full and open competition basis, based upon responses to this notice, is solely within the discretion of the government. Oral communications are not acceptable in response to this notice. No RFP will be issued based upon this Notice of Intent.
