Solicitation # 36C79126R0011
The Department of Veterans Affairs is soliciting proposals under Solicitation Number 36C79126R0011 to establish multiple single-award, Firm-Fixed-Price, Indefinite Delivery/Indefinite Quantity (IDIQ) base contracts for the Electro-Therapeutic Modalities for Pain Management (ETMPM) and Transcutaneous Electrical Nerve Stimulation (TENS) Procurement Program. This national program provides FDA-cleared electro-therapeutic devices and accessories to VA Medical Centers and Community-Based Outpatient Clinics to support non-opioid pain management. The scope includes portable TENS devices, Interferential Current (IFC) devices, thermal and non-thermal Short-Wave Diathermy devices, and portable Neuromodulation systems for headache disorders, along with associated accessories such as electrodes and lead wires. The procurement utilizes a VA Tiered Set-Aside Evaluation Approach, prioritizing awards sequentially from Tier 1 (SDVOSB), Tier 2 (VOSB), Tier 3 (Other Small Businesses), to Tier 4 (Other-Than-Small Businesses). Evaluation methodologies vary by item: CLINs X001 through X004 are evaluated using the Lowest Price Technically Acceptable (LPTA) method, where price is the deciding factor, while CLIN X005 is evaluated via a Best-Value Tradeoff, weighting technical factors at 60%, price at 25%, and past performance at 15%. Responsive proposals must include a signed SF 1449, a Technical Capability Statement, FDA 510(k) clearance letters, and three past performance documents. Non-manufacturers must provide OEM-issued Authorized Distributor Letters. Mandatory certifications include the Buy American Certificate for small businesses (Tiers 1-3) and the Trade Agreements Certificate for large businesses (Tier 4), as well as the Limitations on Subcontracting certification. All offerors must submit required product samples to the Denver Logistics Service facility. Following several amendments, the final deadline for all proposal documentation and product samples is November 2, 2026, at 12:00 PM CDT.

SOLE SOURCE MEMORANDUM TO ACQUIRE CORTECH SOLUTIONS, INC. ELECTROENCEPHALOGRAM (Purchase Request 1301004837) 1. Identification of the agency and the contracting activity, and specific identification of the document as a - Sole Source Justification. This is a sole source justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001 (Contracts Department Code 02). 2. Nature and/or description of the action being approved. This action will award a WOSB sole source, firm fixed price purchase order pursuant to FAR 19.1506(b) to Cortech Solutions, Incorporated to acquire a commercial off-the-shelf (COTS) electroencephalogram (EEG) for use at the Navy Experimental Diving Unit (NEDU). This is required equipment for upgrading hyperbaric test equipment, facilities atmospheric control, life support and physiological systems. 3. A description of the supplies or services required to meet the agency's needs. (including the estimated value). The contract effort is to acquire the following: Qty (1) ActiveTwo 64+8 System Components This acquisition will be conducted using simplified acquisition procedures with a total estimated value of less than $250k. The Government's minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This purchase will be funded with FY2022 Operation and Maintenance, Navy (OMN) funds. 4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor's unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c)(1), 10 U.S.C. 2304(d)(1)(B). Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements FAR 6.302-1(a)(2)(iii)(B). The equipment listed above is provided by Cortech Solutions, Inc., and they are the only source for that meet this requirement for the following reasons. NEDU has spent significant resources designing the first ever EEG system rated to 1,000 fsw. The ActiveTwo EEG is the only EEG system which fits inside the pressure enclosure. Cortech Solutions Incorporated is the sole U.S. distributor of this system. Use of an alternate EEG system would result in a complete redesign of NEDU's EEG system and tens of thousands of dollars of rework. This would also results in a major schedule impact due to the time needed to design a new system that works with a different EEG system. Finally, data acquired with a different model EEG system may not be directly comparable to the data gathered using the current system which would render previous data and testing useless. Therefore, it is imperative that the EEG system from Cortech Solutions Incorporated is acquired so that continuity of equipment be maintained. 5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b). The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government's needs. 6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted. For the reasons specified in paragraph 4 above, Cortech Solutions Incorporated is the only source that can meet the Government's needs. This requirement will be synopsized in the government point of entry SAM.gov. 7. Any other facts supporting the justification. None 8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made. As stated in paragraph 4 above, Cortech Solutions Incorporated is the only source that can meet the Government's needs.
