Amendments to Rule 207 Title V Federal Operating Permit Program, July 24, 2025

The Sacramento Metropolitan Air Quality Management District is implementing amendments to Rule 207, the Title V Federal Operating Permit Program, to comply with federal Clean Air Act requirements. These regulatory changes specifically remove two court-vacated elements: the emergency affirmative defense provisions and greenhouse gas requirements related to the Supreme Court ruling on the EPA's GHG Tailoring Rule for Title V. The project applies to both incorporated and unincorporated areas within Sacramento County. This action is classified as a regulatory rule amendment rather than a procurement contract for goods or services. Consequently, it has been issued a Notice of Exemption from the California Environmental Quality Act under Public Resources Code Section 21084(c) and CEQA Guidelines Section 15060(c)(2), as the amendments will not result in direct or reasonably foreseeable indirect physical changes to the environment. The project is managed by the Program Supervisor and was formally documented in August 2025.
