  1. This is a combined synopsis/solicitation for commercial products or commercial services prepared in accordance with part 12. This announcement constitutes the only solicitation. Offers are being requested and a separate written solicitation will not be issued.

NON-COMPETITIVE Solicitation number 75N98026Q00660  is issued as a request for quotation (RFQ) for maintenance and service for Government-Owned BD LSR Fortessa Cell Analyzer (Decal# 01825187, Serial # H5B200003)

THIS IS A NON-COMPETITIVE (NOTICE OF INTENT) COMBINED SYNOPSIS SOLICITATION TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL AND OPEN COMPETITION (INCLUDING BRAND-NAME). 


The Office of Mission Acquisition Solutions (OMAS), Office of Acquisition (OA), on behalf of the National Institutes of Health (NIH), National Cancer Institute (NCI), intends to negotiate and award a purchase order without providing for full and open competition (including brand-name) to BD, 155 North McCarthy Blvd. Milpitas, CA 95035 for maintenance and service of  Government-Owned Becton Dickinson and Company LSRFortessa Cell Analyzer.


This acquisition is conducted as non-competitive for a commercial product or commercial services and is conducted pursuant to FAR 12.201-1, Simplified Procedures in accordance with 41 U.S.C. 1901.
This requirement is for the following services:


  1. Maintenance and Service Contract for Government-Owned Becton Dickinson and Company (BD Biosciences) Company LSRFortessa Cell Analyzer as detailed in the Statement of Work. See the attached Statement of Work – Attachment 1.

(iii)          Description of requirement:


The Contractor shall provide all labor, material, and equipment necessary to maintain and provide preventive maintenance for the BD equipment listed above with three lasers (Blue, Red and Ultraviolet) and one FACStation. See the attached Statement of Work – Attachment 1.


  1. Period of Performance
    The Government anticipates award of a firm fixed-price purchase order for this acquisition, and the anticipated period of performance is 08/01/2026 – 07/31/2027.

352.203-70 Anti-Lobbying (DEC 2015)


Pursuant to the HHS annual appropriations acts, except for normal and recognized executive-legislative relationships, the Contractor shall not use any HHS contract funds for:


(a) Publicity or propaganda purposes;


(b) The preparation, distribution, or use of any kit, pamphlet, booklet, publication, electronic communication, radio, television, or video presentation designed to support or defeat the enactment of legislation before the Congress or any State or local legislature or legislative body, except in presentation to the Congress or any state or local legislature itself; or designed to support or defeat any proposed or pending regulation, administrative action, or order issued by the executive branch of any state or local government, except in presentation to the executive branch of any state or local government itself; or


(c) Payment of salary or expenses of the Contractor, or any agent acting for the Contractor, related to any activity designed to influence the enactment of legislation, appropriations, regulation, administrative action, or Executive order proposed or pending before the Congress or any state government, state legislature or local legislature or legislative body, other than for normal and recognized executive-legislative relationships or participation by an agency or officer of a state, local, or tribal government in policymaking and administrative processes within the executive branch of that government.


(d) The prohibitions in subsections (a), (b), and (c) above shall include any activity to advocate or promote any proposed, pending, or future federal, state, or local tax increase, or any proposed, pending, or future requirement for, or restriction on, any legal consumer product, including its sale or marketing, including, but not limited to, the advocacy or promotion of gun control.

EVALUATION


                The provision of the FAR 52.212-2, Evaluation – Commercial Products and Commercial Services  (DEVIATION) (RFO AUG 2025), applies to this acquisition. 


  1. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:

 a) Technical capability of the item offered to meet the Government requirement;


b) Price; and


c) Past performance


Technical and past performance, when combined, are significantly more important than cost or price.


  1. Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

A determination by the Government whether to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will be considered to determine whether to proceed on a non-competitive basis as indicated above, or to conduct a competitive procurement.


(viii)       The following additional contract requirement(s) or terms and conditions as determined by the contracting officer are necessary for this acquisition and consistent with customary commercial practices. The associated NAICS code 811210 - Electronic and Precision Equipment Repair and Maintenance, and the small business size standard is $34M.  


FAR DEVIATION STATEMENT: “System updates may lag policy updates. The System for Award Management (SAM) may continue to require entities to complete representations based on provisions that are not included in this solicitation. Contracting officers will rely on representations from offers based on provisions in the solicitation. Entities are not required to, nor are they able to, update their entity registration to remove these representations in SAM.”


Responses to this solicitation must include sufficient information to establish the interested parties’ bona-fide capabilities of providing the services. The price quote shall include unit price, list price, shipping and handling costs, delivery days after contract award, delivery terms, prompt payment discount terms, F.O.B. Point (Destination or Origin), product or catalog number(s), product description, and any other information or factors that may be considered in the award decision. Such factors may include special features required for effective program performance, trade-in considerations, probable life of the product selected as compared with that of a comparable product, warranty considerations, maintenance availability, and environmental and energy efficiency considerations.


Responses to this solicitation must include clear and convincing evidence of the offeror’s capability of fulfilling the requirement as it relates to the technical evaluation criteria. The price proposal/quote must include the labor categories, an estimate of the number of hours required for each labor category, fully loaded fixed hourly rate or each labor category, breakdown and rationale for other direct costs or materials, and the total amount.


The Unique Entity ID (UEI) from SAM.gov, the Taxpayer Identification Number (TIN), and the certification of business size must be included in the response. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov.
