The California Department of Toxic Substances Control (DTSC), pursuant to authority granted under California Code of Regulations, Title 22, Division 4.5, Chapter 20 is approving an Addendum to a previously adopted Initial Study/Negative Declaration for renewal of a Hazardous Waste Facility Permit (Permit) for Crystal Clean, LLC (formerly Heritage-Crystal Clean, LLC). DTSC prepared an Addendum pursuant to a previously adopted 2015 Initial Study/Negative Declaration (IS/ND) due to minor changes and updates to the CEQA Guidelines. The Permit Renewal will authorize continued storage and treatment of hazardous waste. In addition, Crystal Clean, LLC (Crystal Clean) proposes additional capacity and flexibility of containers in Units 3 and 4 to facilitate waste acceptance and movement of oily water; installation of two (2) 18,000-gallon storage containers in Unit 5-3 (T-5 and T-6) on the existing concrete pad; expansion of testing capabilities of water from storm water and tank/container rinse water; and administrative waste code changes. The Permit does not include any significant changes in operations and no construction or ground disturbing activities are proposed. Crystal Clean is located at 1620 East Brundage Lane in Bakersfield, California 93307.
Background: Crystal Clean is located on an approximately 4.3-acre parcel that is shared with Sierra International Machinery, which occupies the majority of the parcel and surrounds the facility to the east and south. Crystal Clean is a treatment and storage facility whose operations include the collection and storage of used oil, used antifreeze, oily water, contaminated petroleum sludge, and oily solids from offsite generators (gas stations, oil changers, auto repair shops, etc.); treating used oil and oily water to meet recycled oil standards; and treatment of contaminated petroleum sludge. Crystal Clean receives these hazardous wastes via tanker trucks, vacuum trucks, railcars, and in containers from off-site generators. Wastes are consolidated by type and stored in permitted tanks and storage areas before being treated and/or shipped to an offsite facility. Crystal Clean consists of six permitted hazardous waste transfer and storage units; Tank Farm (Unit 1), Drum Storage Area (Unit 2), Roll-Off Bin Storage Area (Unit 3), Drum Loading/Unloading Area (Unit 4), and Truck and Railcar Loading/Unloading Area (Unit 5). There are no proposed changes to current hazardous waste storage and treatment activities with the proposed Permit Renewal other than the:
Addition of two (2) portable containers with capacities less than 20,000 gallons each and the addition of four (4) 20-cubic yard roll-off bins in Unit 3 (Roll-Off Bin Storage Area);
Flexibility of containers in Units 3 and 4 to facilitate waste acceptance and movement of oily water;
Installation of two (2) 18,000-gallon storage tanks Oily Water Tank (Tank 5) and Recycled Oil
Tank (Tank 6) in Sub-Unit 5-3 on an existing concrete pad;
Expansion of the testing capabilities of waste determination testing on collected stormwater and tank/container rinse water accumulated on site, to determine if the water meets
requirements of the facilitys wastewater discharge permit and would then be managed accordingly based on the analytical results; and
Administrative waste code changes, specifically the addition of waste code #181 to Unit 2 (Drum Storage Area) and Unit 4 (Drum Loading/Unloading Area) as an acceptable waste stream.
Change the name of the Facility from Heritage-Crystal Clean, LLC to Crystal Clean, LLC;
Bakersfield Transfer, Inc. (BTI), the predecessor to Crysal Clean, was issued their first Permit by DTSC in 2010, which allowed them to store used oil, used antifreeze, oily water and oily solids only with no treatment of used oil. On May 26, 2010, BTI submitted a new Permit application to DTSC for a California-Only Hazardous Waste Facility Permit which allowed BTI to treat used oil and certify the treated used oil as recycled oil in accordance with California Health & Safety Code Section 25250.1. DTSC circulated an IS/ND (State Clearinghouse Number 2015031014) for public comment in March of 2015 and filed a Notice of Determination (State Clearinghouse Number 2015031014) in July of 2015 for approval of the Permit. DTSC issued a Permit effective July 28, 2015, reflecting certification of these new Permit conditions. DTSC approved a Permit modification request for a change in ownership from BTI to Heritage-Crystal Clean, LLC on August 13, 2021, and filed a Notice of Determination on August 16, 2021 (State Clearinghouse Number 2015031014). This Addendum is to the previously adopted IS/ND and has been prepared to address activities associated with the Permit enewal request and to amend the analysis of the previously adopted 2015 IS/ND due to updates to the CEQA Guidelines, not as a result of project changes. The Permit Renewal will authorize the Facility to continue operating as a commercial hazardous waste storage and treatment facility and implement the proposed changes. All other operating activities of the Facility will continue as previously approved. This Permit Renewal does not include any construction, ground disturbing activities, or other operational changes and all previous Permit requirements will remain in effect. This Permit Renewal will not result in any new or substantially more severe significant impacts on the environment.
