The Capitol 101 Tentative Tract Map Amendment project at 3411 Capitol Avenue in Fremont, California, seeks approval to subdivide the property into 126 residential condominium lots and two commercial lots within the Downtown District and Central Community Plan Area. The proposal is supported by a categorical exemption under the California Environmental Quality Act (CEQA), specifically Section 15332 for infill development and Section 15183 due to consistency with the previously adopted and environmentally reviewed Downtown Community Plan, which already underwent a Final Supplemental Environmental Impact Report. No additional environmental review is required, as the project aligns with the density and character established by the community plan. The amendment is a land use action overseen by the City of Fremont’s Planning Division, with no federal procurement elements, contract pricing, or FAR clauses applicable. The project’s regulatory compliance is tied to adherence to the Fremont Municipal Code, including provisions for air quality controls, biological resource protection, and stormwater management. The Notice of Exemption was posted on July 29, 2025, and the planning file number PLN2025-00185 identifies the application. Point of contact for the project is Kevin Lee, Planner II, with Rishi Khanna of SPSD Developers listed as the applicant representative. All activities are centered at the project site in Fremont, CA 94538, and formal acceptance is determined by the City of Fremont upon verification of compliance with applicable environmental and land use standards. No delivery schedules, payment terms, contracting officer representatives, or procurement evaluation criteria are present, as this is not a federal contract but a local land use and environmental compliance matter.

To consider an amendment to the approved Capitol 101 project’s Tentative Tract Map No. 8485 to allow a condominium subdivision consisting of 126 residential lots and two commercial lots at 3411 Capitol Avenue in the Downtown District and Central Community Plan Area, and to consider an exemption from the requirements of the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15332, Infill Development Projects, and a finding that no further environmental review is required pursuant to CEQA Guidelines Section 15183, as the project is consistent with the density established by the Downtown Community Plan for which a Final Supplemental Environmental Impact Report (SCH #2010072001) was previously prepared and certified. Each of the foregoing provides a separate and independent basis for CEQA compliance.
