Merit Systems Protection Board Financial and Administrative Management Office 1615 M Street, NW, Ste 500 Washington, DC 20036 _____________________________________________________ Nature of the Action: The Merit Systems Protection Board, Information Resource Management Department, requests a limited source procurement of Tyler Technologies Case Management Development Platform Annual Support/Upgrade Subscription, Hosting and Report Database platform listed on requisition number MSP170000-2024-0019. This procurement is a logical follow-on of 47QTCA23D00C2 , is available from only one source, and competition is precluded for the reasons indicated below. There are no substitutes available for the same cost and benefit to the Government. _____________________________________________________ Description of the Supplies or Services: Annual Support/Upgrade Subscription for entellitrak/Tyler Technologies Case Management Platform, Report Builder, eFile and Document Management; Hosting; Data growth; Development Platform; and Report Database platform. Explain why the particular brand name, products or features of the product from one source can only satisfy the specialized nature of the Government's requirement. Attach a list of the brand name products (Note: Explaining the products capability or process is not adequate rationale). The Merit Systems Protection Board implemented Tyler Technologies Case Management Platform (entellitrak) in October 2023, and is nearing the completion of a five-year Modernization Project to transform its e-adjudication platform and all business software systems used by the Agency using the entellitrak platform. The successful implementation and completion of this project is urgently necessary to follow Federal mandates, mitigate costs and great security risks associated with maintaining end of life servers and systems. Specific characteristics of the Entellitrak annual support, licensing and hosting limit the availability to Tyler Technologies, as they are the architects of MSPB's e-Appeal case management system. This enterprise level system is used by Agency staff, stakeholders and the public for appeal creation, appeal and document management, workflow processes and data and is key to all MSPB mission critical activities and business processes. If applicable, explain the contractor's unique qualifications to provide the supplies or services. Tyler Technologies as the developer and architect of the e-Appeal platform is actively working with MPSB subject matter experts (SMEs) and stakeholders to further develop and implement the enterprise case management solution (e-Appeal) for the Agency. Tyler Technologies familiarity with and institutional granular knowledge of the MSPB business process is essential to this effort and will prevent unnecessary repetition of effort, expenditure, and use of resources. To select another platform option, develop and deploy a different system, and train the employees and system users would halt and disrupt MSPB critical mission objectives and have negative impact on the government, public and stakeholders. In conclusion, in accordance with FAR 8.405-6(a)(1)(i)(B), Tyler Technologies is the only responsible source capable of providing the services required due without negative impact to the Government, public and stakeholders; award to any other source would result in a duplication of services and costs along with unacceptable delays in fulfilling the Agency mission as well as completing the Modernization Project. List other companies similar products and explain why the products lack particular features, do not meet, or cannot be modified to satisfy the Government's requirement. There are no products that can be similarly compared at this time as the entellitrak Tyler Case Management Platform has been tailored to fit MSPB complex business requirements, and that work is still in progress. ____________________________________________________ Best Value: (The Contracting Officer will explain how the order represents the best value FAR 8.404(d)) _____________________________________________________ Market Research: (Explain market research conducted among FSS holders and the findings or why it was not conducted, FAR 10) Market research shows that selecting a different enterprise case management platform, licensing, support, and hosting would halt the Agency's ability to perform its mission.
