Solicitation # CW2474502
Public Services and Procurement Canada (PSPC) is conducting a follow-up Request for Information (RFI) under solicitation number CW2474502 to gather industry feedback for the development of a procurement strategy regarding Information Products and related services. This consultative process focuses on defining data categories, procurement models for static and outcome-based content, and general terms and conditions, specifically regarding liability and indemnification. The RFI explicitly excludes satellite imagery and seeks to balance technical merit, price, and contractual acceptability. Responses are due by March 31, 2027. Proposed contractual frameworks include a performance management system based on cost, quality, schedule, and management, with a verification period of ten business days for the acceptance of licensed products. Key terms under consideration include a liability cap limited to the contract value of the preceding 12 months and a requirement for content authenticity to ensure human authorship over AI-generated content. The procurement strategy is exploring various award models, including a highest-ranked bidder negotiation process and a scoring system that favors suppliers who accept Canada's contractual framework without amendment. Payment is slated for 30 days following the receipt of an undisputed invoice via electronic instruments.

The following is an amendment to the initial posting to revise the FAR reference and the anticipated period of performance of the contract. Changes are in bold text. The Commodity Futures Trading Commission (CFTC) intends to procure licensed access to Clarus Financial Technology's "Clarus SEFView and Clarus SDRView Professional" on a sole source basis. In carrying out the agency's mission, CFTC requires access to real-time, diversified financial news, information and data. Specifically, Clarus provides a single platform to obtain the following unique capabilities such as normalized and aggregated SEF and SDR data, data drilldown functions, benchmarks of DCM swaps, MM futures and bonds, linked sources of rates, credits and FX trades for SDR and full history of SEF data from inception. There is no known alternative source that provides the daily SEF activity, daily SDR reportable trades and the other information required by CFTC which is available through the identified Clarus products. A subscription to the Clarus services will provide the necessary information, data and analytics to support CFTC's mission for market regulation. The Government intends to procure this requirement under the Simplified Procedures for Certain Commercial Items, 41 U.S.C. 1901 as implemented by FAR Subpart 13.5. The identified vendor is the sole provider of the information and data required by CFTC. The anticipated contract will have a base period of a one (1) year and four (4) one (1) year optional periods for a total period of performance of five (5) years. Therefore, this vendor is the only responsible source identified as reasonably available that will satisfy the agency requirements. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS and a solicitation will not be issued. However, the Government will consider responses from all responsible sources received by the date and time identified above. Written responses must include sufficient information to establish capability to fulfill the requirement. Oral communications are not acceptable in response to this notice. Any responses received will only be considered for the purposes of determining whether to conduct a competitive procurement in lieu of the sole source described in this notice, and such determination shall be made at the sole discretion of the CFTC.
