Contracts Disputes Act Claims Analysis Services Sources Sought Notice

The Indian Health Service, under the U.S. Department of Health and Human Services, is conducting market research through a Sources Sought Notice to identify qualified business concerns capable of providing Contract Disputes Act Claims Analysis Services. The requirement seeks contractors with expert-level experience in the Indian Self-Determination and Education Assistance Act, Contract Support Costs, and CDA claims analysis, specifically to support IHS in analyzing CSC calculations for Title I and V ISDEAA contracts, preparing claims-related documentation, and assisting in negotiations and reconciliations with Tribal governments and legal counsel. Responses must include a tailored capability statement formatted with a cover page containing company name, business size status, UEI number, primary NAICS code, SAM registration status, and existing federal contracting vehicles, followed by an executive summary, technical objectives, up to five relevant past performance examples, and any additional helpful information, limited to ten pages excluding past performance. The statement must be submitted via email to cynthia.cason@ihs.gov by May 29, 2026, with the subject line including the project title and company name. Contractors must be registered in SAM.gov and, if identifying as an Indian Economic Enterprise or Indian Small Business Economic Enterprise, must submit a completed representation form certifying compliance with the Buy Indian Act under 25 U.S.C. 47 and HHSAR 326.601. The contractor is expressly prohibited from providing legal representation on behalf of the government and must not include any classified, confidential, or sensitive information in submissions. Key personnel must include a Senior Partner or equivalent and a Partner or equivalent with demonstrated expertise in the required areas. The anticipated period of performance includes a twelve-month base period with four additional twelve-month options, with an initial award expected in August 2026.
