The scope includes men's and women's shorts, pants, jackets, and both long and short-sleeved polo and button-down shirts, specifically utilizing CX360 brand apparel. Inquiries Inquiry 94999 | Will the Department identify, upon award, a designated receiving contact(s) at each of the 25 institutions authorized to sign for and reconcile deliveries, and confirm a period after delivery, for example, 10 business days, within which the institution must provide written notice of shortage or nonconformity, absent which delivered items are deemed received as reflected on the signed carrier proof of delivery and accompanying packing documentation? | Answer: Per Contract section 1.2.2, DRC will provide a list of business administrators and warehouse managers for each of the institutions upon Contract award. The State will not provide or confirm a timeframe for acceptance after delivery. | Answered: 8/20/2026 Inquiry 95002 | Section 1.2.3 does not state a maximum aggregate deduction. Will the Department confirm whether cumulative deductions on a given purchase order are capped, and in any event confirm that cumulative deductions will not exceed 100% of the value of the affected items? Bidders would also ask the Department to consider stating a per-order cap, for example, 10% of the value of the undelivered items, which allows bidders to quantify this exposure in unit pricing rather than reflect an open-ended contingency. | Answer: There is no maximum aggregate deduction and there will be no per order cap on deductions outlined in Contract section 1.2.3. | Answered: 8/20/2026 Inquiry 95005 | Section 1.2.3 provides for a 1% per business day deduction if an improper invoice is not corrected within two business days. Will the Department confirm that the two-business day period runs from the Contractor's receipt of written notice identifying the specific defect and the information required to correct it, consistent with OAC 126-3-01, and whether the deduction is measured against the disputed line items or the total invoice value? | Answer: The two business day period begins when DRC rejects the invoice. OAC 126-3-01 does not apply; per the Payment Due Date and Process section of the Standard Terms and Conditions, ORC 126.30 applies. The deduction applies to the total invoice value. | Answered: 8/20/2026 Inquiry 95008 | Will the Department confirm that deductions under Section 1.2.3 will not be assessed, and that the delivery period under Section 3.4 is tolled, for delay attributable to causes beyond the Contractor's reasonable control, including: (a) any period during which the Contractor is awaiting information required to fulfill the order, including institutional rocker designation, hem or inseam length, badge finish, or Velcro loop panel specification. | Answer: Delivery timelines will not begin until DRC has provided all required information and approvals. | Answered: 8/20/2026 Inquiry 95011 | Will the Department confirm that deductions under Section 1.2.3 will not be assessed, and that the delivery period under Section 3.4 is tolled, for delay attributable to causes beyond the Contractor's reasonable control, including: (b) pending DRC approval of patch placement under Section 1.2.1. | Answer: Delivery timelines will not begin until DRC has provided all required information and approvals. | Answered: 8/20/2026 Inquiry 95014 | Will the Department confirm that deductions under Section 1.2.3 will not be assessed, and that the delivery period under Section 3.4 is tolled, for delay attributable to causes beyond the Contractor's reasonable control, including: (c) amended or cancelled purchase orders. | Answer: The service level requirements in section 1.2.3 may still apply to cancelled and amended POs. | Answered: 8/20/2026 Inquiry 95017 | Will the Department confirm that deductions under Section 1.2.3 will not be assessed, and that the delivery period under Section 3.4 is tolled, for delay attributable to causes beyond the Contractor's reasonable control, including: (d) manufacturer production delay, capacity allocation, or material shortage affecting brand-specific items for which no substitution is permitted under Section 3.3. | Answer: Service level requirements will be assessed as outlined in Section 1.2.3 of the Contract at DRC's discretion. | Answered: 8/20/2026 Inquiry 95020 | Will the Department confirm that deductions under Section 1.2.3 will not be assessed, and that the delivery period under Section 3.4 is tolled, for delay attributable to causes beyond the Contractor's reasonable control, including: (e) closure or unavailability of the ordering institution's receiving function during the hours specified in Section 3.4. | Answer: The service level requirement in section 1.2.3 regarding late delivery will not be assessed if there is a closure while the goods are being delivered. | Answered: 8/20/2026 Inquiry 95023 | Will the Department confirm that deductions under Section 1.2.3 will not be assessed, and that the delivery period under Section 3.4 is tolled, for delay attributable to causes beyond the Contractor's reasonable control, including: (f) force majeure? | Answer: The service level requirements in section 1.2.3 will not be assessed during a force majeure event. | Answered: 8/20/2026
