AI Contract Overview

The Naval Undersea Warfare Center Division, Newport (NUWCDIVNPT) is pursuing a sole-source, Firm Fixed Price contract with Applied Systems Engineering (ASE) for the evaluation and potential repair of three Model 327X and 327Ku Magnetron transmitters. Under solicitation N6660424Q0375, the project is structured with initial CLINs 0001-0004 for the technical evaluation and inspection phase, followed by option CLINs 0005-0007 for the actual repairs, provided the units are deemed repairable. ASE is designated as the sole source because they are the Original Equipment Manufacturer and owner of the proprietary intellectual property, making them the only vendor capable of sourcing replacement parts and performing accurate repairs. The scope of work requires the contractor to conduct thorough inspections and provide a Technical Report Study/Services evaluation for each unit. Upon government approval and contract modification, ASE will execute the necessary hardware repairs. This procurement, categorized under NAICS 811310, is intended to avoid the significantly higher cost of purchasing three new replacement transmitters. The contractor must adhere to strict security compliance, including NISPOM and OPSEC requirements, and provide detailed reporting on Government Furnished Property.

NUWCDIVNPT intends to purchase, on a Firm Fixed Price (FFP), the evaluation with the option to repair (3) ASE transmitters in accordance with the attached combined Solilcitation/Synopsis and Statement of Work (SOW). This solicitation requests pricing quotation for evaluations under CLINs 0001-0004. After contract award and completion of the evaluations in CLINs 0001-0004, the contractor shall provide quotations for option CLINs 0005-0007 repairs (If repair is possible). Pricing of option CLINs 0005-0007 shall be set upon execution of the option. This requirement is being solicited on a Sole Source basis to Applied Systems Engineering (ASE), as concurred with by the Naval Undersea Warfare Center Division, Newport (NUWCDIVNPT) Office of Small Business Programs (OSBP). The notice of intent is not a request for competitive proposals. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered for the purposes of determining whether to conduct a competitive requirement in the future. Summary of the rationelle to pursue a sole source procurement is as follows: Applied Systems Engineering, Inc. (ASE) is the Original Equipment Manufacture (OEM) of the Model 327X Magnetron and Model 327Ku Magnetron transmitters. As the owner of the transmitter's intellectual property and proprietary information, ASE is the only vendor capable of conducting an accurate evaluation of the transmitter and providing NUWCDIVNPT a valid quote for the necessary repairs. ASE is also the only vendor capable of sourcing required replacement parts and equipment and repairing the transmitters. To consider a source other than ASE, repairs would not be possible, and 3 new replacement transmitters would have to be purchased at an expected cost of $360,000 ($120,000 per unit).
