AI Contract Overview
The County of San Mateo, following the 1963 Supreme Court ruling in Gideon v. Wainwright, established in 1969 the Private Defender Program (PDP) in partnership with the San Mateo County Bar Association to provide legal representation to indigent defendants. Operating as a managed assigned counsel system, the PDP oversees a panel of approximately 116 private attorneys who handle a wide spectrum of cases, including misdemeanors, capital murder, child abuse and neglect, mental health cases, CARE Court respondents, and elder care. The program offers extensive support services such as investigative, paralegal, immigration, and social work assistance to ensure comprehensive defense. In 2021, an independent evaluation by Harvey M. Rose Associates confirmed the PDP’s cost-effective and adequate representation but identified six key areas for improvement, resulting in 37 targeted recommendations focused on better data management, oversight, training, staffing, fee structures, and billing practices. The PDP has since been implementing changes based on these recommendations. To continue enhancing the program's effectiveness, the County and the San Mateo County Bar Association entered a five-year contract in 2023 to maintain the PDP’s services through June 2028. Prior to the contract's expiration, the County is initiating a competitive solicitation process to select a qualified contractor to conduct a thorough evaluation of the PDP’s performance against established indigent defense standards. This evaluation will deliver a report outlining findings and providing recommendations aimed at further improving legal defense services for indigent clients in the County. The solicitation, managed by the County Executive’s Office in Redwood City, California, is open for proposals until late May 2026.
