AI Contract Overview
The Bureau of Reclamation's Mid-Pacific Regional Office intends to award a sole source, firm fixed-price contract to Siskiyou County, California, for pesticide monitoring and enforcement services on agricultural lands within the Tule Lake and Lower Klamath National Wildlife Refuges. Siskiyou County is the only legally authorized entity under California Food and Agricultural Code §11501.5 to perform these functions within the county, which prohibits private or federal entities from undertaking pesticide inspection, enforcement, and monitoring in this jurisdiction. The contract period includes one base year commencing June 1, 2026, with four successive 12-month option years, extending through May 31, 2031. The acquisition is non-competitive, conducted under FAR 13.106-1(b)(1) due to the unique statutory authority vested in the County Agricultural Commissioner, whose certified agricultural inspectors are empowered to enforce pesticide laws, conduct compliance inspections, and issue violations on those federal wildlife refuge lands. The solicitation allows other responsible sources to submit capability statements demonstrating statutory authority to perform these services, but no other qualified entities are known. The scope of work includes comprehensive pesticide regulatory enforcement, requiring 100% inspection of restricted use pesticides such as Sectagon-42 and Telone II, 100% compliance monitoring of chemigation systems, and a minimum 25% inspection rate for other pesticide applications including chlorpyrifos, metribuzin, and dimethoate. The contractor must ensure adherence to federal, state, and DOI policies, including requirements from the California Food and Agricultural Code, EPA regulations, and Pesticide Use Proposals (PUPs). Monitoring tasks encompass visual observations, field inspections, education of applicators, enforcement actions, and immediate reporting of violations and incidents to the Contracting Officer’s Representative (COR) within 48 hours. Deliverables include preapplication site inspection reports, pesticide use monitoring reports, field activity reports, and an annual pesticide use summary in Excel format, documenting product details, application rates, and acreage treated. Performance adherence is evaluated on a strict pass/fail basis per the Quality Assurance Surveillance Plan (QASP), emphasizing timely reporting, meeting scheduled inspections, and prompt enforcement notification. The contract excludes government-furnished property and does not require security clearances. Administrative points of contact are provided for correspondence, but payment and pricing details are not included in the solicitation, underscoring this action as a non-competitive awarding based on statutory exclusive jurisdiction and established operational responsibilities.
