AI Contract Overview

The contract solicits a vendor to install fuel tank monitoring systems across all designated County fuel sites in Walton County, Florida, and provide on-demand deliveries of unleaded gasoline and diesel fuel. The vendor is responsible for continuously monitoring fuel levels and ensuring deliveries occur either when tanks reach approximately 20% capacity or within 24 hours upon County request. Deliveries are to be made via tank wagon or bulk transport, depending on the site, and all fuel supplied must meet ASTM standards and comply with applicable State of Florida regulations. Pricing is to be based on the OPIS Pensacola rack average plus a vendor-submitted markup per gallon, and all invoices must reflect temperature-adjusted fuel quantities at 60°F with any applicable taxes and fees added. The Public Works Director or designated representative is the primary point of contact for coordinating service and delivery. Service locations include multiple County facilities with specified delivery windows primarily from 6 a.m. to 4 p.m., Monday through Thursday, with some sites accepting deliveries seven days a week. The agreement is set for an initial term of one year from the date of execution, with the County retaining the option to renew the contract for up to four additional one-year periods at its sole discretion. The solicitation process is managed electronically through Walton County’s OpenGov procurement portal, with established submission deadlines and no physical or emailed bids accepted. Contractual requirements include compliance with all relevant federal, state, and local regulations—such as OSHA, Fair Labor Standards Act, and Davis-Bacon wage laws—as well as insurance coverage including workers’ compensation and cyber liability. The County requires disclosures related to conflicts of interest, prohibitions against contingent fees, and adherence to drug-free workplace policies. The contract incorporates provisions for audit rights, change orders for scope adjustments, warranties on work performed, and indemnity against intellectual property claims. Deliveries and work inspections occur at the County fuel sites, with acceptance contingent on conformity to contract specifications. The vendor must submit multiple certifications and attachments, including tax identification, non-collusion affidavits, and various compliance forms upon award. Pricing evaluation is based on best value rather than lowest bid alone, and the contract does not specify a guaranteed quantity, relying on monitored fuel levels and on-demand requests to determine fuel delivery volumes.
