The Broadcasting Board of Governors/International Broadcasting Bureau intends to award a non-competitive contract to Arqiva, Inc. for the lease of one High Definition video channel at 3.5 Megabits and one radio channel at 256 kilobits on the Yahsat satellite at 52.5E, East Beam Transponder 15. The contract is expected to have a base period of one year with four subsequent one-year option periods. This procurement is being conducted without full and open competition because Arqiva, Inc. is the operator of the specific transponder required. Securing a position on Transponder 15 is critical for the agency to maximize viewership and deter signal jamming, as the transponder also hosts high-visibility broadcasters such as the BBC, CNN International, and Euronews. While the government intends to negotiate with Arqiva, Inc., interested firms may submit written responses by May 6, 2015, demonstrating their ability to provide the same specific satellite lease requirements and providing evidence of transponder ownership.

THIS IS A NOTICE OF INTENT. The Broadcasting Board of Governors/International Broadcasting Bureau (BBG/IBB), Office of Contracts (CON) located in Washington, D.C. intends to negotiate and award a non-competitive contract to Arqiva, Inc., 2101 L Street, NW, Washington, DC, 20037-1526for the lease of one (1) High Definition (HD) video channel at a bit rate of 3.5 Megabits (MB) and one (1) radio channel at a bit rate of 256 kilobits (KB) on the Yahsat satellite at 52.5E, East Beam Transponder 15, 11.996 GHz.. The anticipated period of performance is one year after contract award with four (4) one-year Option Periods. The statutory authority permitting other than full and open competition that is applicable to this procurement is 41 U.S.C. 253(c)(1) which is implemented at FAR Subpart 6.302-1 as follows: "When the supplies or services required by the agency are available from only one responsible source, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for. Arqiva, Inc. (USSI) is the only vendor with the capability and expertise to lease to BBG (1) High Definition (HD) video channel at a bit rate of 3.5 Megabits (MB) and one (1) radio channel at a bit rate of 256 kilobits (KB) on the Yahsat satellite at 52.5E, East Beam Transponder 15, 11.996 GHz. Arqiva, Inc., is the operator of transponder 15 at 11.996 GHz. The bouquet on transponder 15 includes British Broadcast Corporation (BBC) Persian, BBC Arabic, Cable News Network (CNN) International, Europe News (Euronews) and BBC World Service. It is imperative for BBG to be on transponder 15, as this will increase BBG's viewership potential and also serve as a deterrent to jamming the BBG broadcast signal, as it would problematic for the interfering party to interfere with the group of other high visibility broadcasters on transponder 15. In addition, being on transponder 15 will fulfill BBG 's mission of reaching the largest audience possible. See attachment titled "Justification for Other than Full and Open Competition" for more details. This Notice of Intent is not a request for competitive price proposals. Interested firms must submit a written response that demonstrates their ability to provide for the lease of one (1) High Definition (HD) video channel at a bit rate of 3.5 Megabits (MB) and one (1) radio channel at a bit rate of 256 kilobits (KB) on the Yahsat satellite at 52.5E, East Beam Transponder 15, 11.996 GHz. See attachment titled "Statement of Work" for additional details. Interested firms must state how they would fulfill the requirement above and include appropriate documentation describing the number of years they have been providing such services, and evidence of ownership of the transponder. The written response received from interested firms shall provide sufficient detail to allow for an evaluation by the Government without the need for the submission of additional information. The written response must be submitted to Myria Carpenter, Contract Specialist, by Wednesday, May 6, 2015 12:00pm EDST via email at proposalsubmissionMEDC@bbg.gov.
