The Hesperia Phelan CUP24-00012 project, led by the City of Hesperia and proposed by Au Energy, LLC, involves the construction and operation of a commercial facility on a 2.66-acre site at the northwest corner of U.S. Highway 395 and Phelan Road in Hesperia, California. The development consists of a 5,915-square-foot convenience store, five fuel islands with ten pumps under a 4,080-square-foot canopy, and a 1,968-square-foot automated car wash tunnel. The site plan includes 40 parking spaces, featuring 10 EV-capable spaces and two EV charging stations, with approximately 1.88 acres of paved surface and 0.78 acres of landscaped area. Additionally, the project includes improvements to U.S. Highway 395 and the traffic signal at the Phelan Road intersection. The project is subject to rigorous environmental and regulatory compliance under the California Environmental Quality Act. Key requirements include an Incidental Take Permit from the California Department of Fish and Wildlife for the removal of 35 western Joshua trees and mandatory pre-construction burrow surveys to protect burrowing owls. The project also mandates strict protocols for the discovery of archaeological finds, fossils, or human remains, requiring assessments by qualified professionals and coordination with the San Bernardino County coroner and the Yuhaaviatam of San Manuel Nation. Construction must also adhere to specific fire management procedures to mitigate wildfire risks.
