The New York State (NYS) Uniform Code is aligned with the 2020 editions of the International Codes, and the NYS Energy Code is based on the 2020 International Energy Conservation Code (IECC). This alignment ensures substantial consistency with building and energy codes across most states, promoting cost-effective construction practices, ease of material and professional service utilization across state lines, and technological advancement. To maintain this uniformity and reflect technological improvements, NYS recognizes the importance of updating its codes in tandem with other states that base their codes on the International Codes and IECC. Currently, the NYS Department of State has a contract with the International Code Council, Inc. (ICC) to provide services, subscriptions, memberships, and printed materials related to the 2020 NYS Codes. Due to delays in the development of the 2025 codes, the contract is being extended by six months until December 31, 2025, with an additional $49,999 allocated for electronic access to the 2020 Code for municipalities. This extension is a sole-source procurement awarded to ICC, the only provider capable of fulfilling these specific needs, and is exempt from advertising requirements. The contract, valued between one million and five million dollars, covers all counties in New York State and is managed by the NYS Department of State. The contract's purpose is to ensure continued access to essential code materials and services during the ongoing code update process, supporting the state's efforts to maintain consistent, up-to-date building and energy codes that align with national standards. The contract term is set for six months, ending on April 18, 2025, with a primary contact being Leah Golby, Contract Management Specialist 2.

Full Description

Currently, the NYS Uniform Code is based on the 2020 editions of the International Codes and the NYS Energy Code is now based on 2020 editions of the International Energy Conservation Code (IECC).  This makes the NYS Uniform Code substantially similar to building codes in effect in all or parts of the other 49 States, and the NYS Energy Code substantially similar to building energy codes in effect in all or parts of approximately 39 other States.  This substantial uniformity facilitates the use of materials manufactured in one state in other states, facilitates the use of the services of design professionals in one state for projects in other states, and otherwise makes construction more cost effective.  However, as recognized by Executive Law section 377 and Energy Law section 11-103, building codes and building energy codes should be updated from time to time to reflect improved technologies.  It is anticipated that the other States that have building codes based on the International Codes and building energy codes based on the IECC will update their building codes and building energy codes as the International Codes and IECC are updated.  The benefits flowing from substantial uniformity of building codes and energy codes based on the International Codes and the IECC would be lost if New York State does not also update its building code and building energy code, and if such updates are not based on updated editions of the International Codes and IECC.  DOS has a contract in place with the International Code Council, Inc. (ICC). This contract provides International Code services, subscription, membership and printed materials for 2020 NYS Codes. The current code development for 2025 is taking longer than anticipated, and there is a need to extend the contract for an additional six months to 12/31/2025, and add $49,999 of electronic access to the 2020 Code for municipalities.           Reason for advertising exemption: Single Source Award recipient: International Code Council, Inc. Any questions or comments regarding this notice of sole-source, single-source, or procurement otherwise exempt from advertising in the NYS Contract Reporter should be directed to the contact person listed for the contracting agency or public authority. Ad end date:04/18/2025 Contract term: six months County(ies): All NYS counties
