The United States Patent and Trademark Office (USPTO) intends to award a firm fixed price contract to Televic Conference US Corporation for a Service Level Agreement (SLA) to maintain and support the existing Televic Confide microphone system used for simultaneous interpretation at the Global Intellectual Property Academy in Alexandria, Virginia. This sole-source procurement is justified under PTAG 6.1.1 due to the proprietary nature of the Televic hardware and software, which only the original equipment manufacturer can service without incurring excessive costs or risks to system integrity. Market research confirmed that Televic is the only vendor capable of providing OEM-authorized labor, materials, tools, test equipment, transportation, and spare parts for the installed system, making competition infeasible. The USPTO is exempt from the Competition in Contracting Act under the Patent and Trademark Office Efficiency Act, and no solicitation will be issued to the public. The contract includes a one-year base period, followed by two option periods totaling an additional eighteen months, with work to be performed exclusively at the Madison East Building, 600 Dulay St., Alexandria, VA 22314. The vendor must provide comprehensive maintenance, remote and onsite troubleshooting, hardware repair, firmware and software updates, spare part replacement, quarterly reporting, and performance reviews. Key deliverables include a POC and escalation roster, a firmware update plan, root cause analysis reports within 72 hours of any issue, an initial system assessment within 30 days, and an end-of-year system checkup scheduled by the Contracting Officer’s Representative. All personnel must comply with site security protocols, including background checks and escorted access. The contract falls under NAICS code 334310, with no small business set aside applied, and responses to the notice must be submitted in writing by June 4, 2026, to the designated contracting officers.

PTAG Part 6.1.1 Synopsis – Intent to Sole Source

The United States Patent and Trademark Office (USPTO), Office of Policy and International Affairs (OPIA), and the Global Intellectual Property Academy (GIPA) has a brand name justification requirement for a Service Level Agreement (SLA) for the already installed and existing Televic Mic System used for Simultaneous Interpretation in the GIPA Academy. This requirement will ensure secure, available, and fully operational audio/conference capability for scheduled and ad-hoc meetings, including interpretation functionality where applicable. The requirement shall provide maintenance, troubleshooting, repair of hardware, remote (via phone or email) diagnostics, remediation where feasible, onsite support for incidents that cannot be resolved remotely, spare parts management, and replacement for covered components which are proprietary from Televic. The Vendor shall provide all labor, supervision, materials, tools, test equipment, transportation, and Original Equipment Manufacturer-authorized services necessary to maintain and support the Televic Confide system.

For this procurement, the USPTO is exempt from the Competition in Contracting Act (CICA) as the subject requirement is being procured using the Alternative Competition Method in accordance with the Patent and Trademark Office Acquisition Guidelines (PTAG) and the Patent and Trademark Office Efficiency Act 35 U.S.C. 2(b)(4)(A). The full text is located here: https://federalregister.gov/a/2013-24316.

In accordance with PTAG 6.1.1, the USPTO conducted market research which included posting a “for information only” intent to sole source to SAM.gov. The results indicate that only Televic Conference US Corporation 7008 Virginia Manor Road, Beltsville, MD 20708 can meet this brand name USPTO requirement.

Televic Conference US Corporation is uniquely qualified to perform this requirement since the system installed is Televic. Engaging another vendor would require substantial increased costs, and potential risk to performance due to the lack of access to the proprietary items. Televic Conference US Corporation is the only brand and responsible source capable of fulfilling this requirement within the required timeframe and without incurring unnecessary cost or risk to the proprietary components of the Government.
Consequently, per PTAG 6.1.1 (d) the USPTO intends to negotiate and award a firm fixed price contract with Televic Conference US Corporation. This requirement utilizes NAICS code 334310 and has a period of performance of base and two option years.
This notice of intent is not a request for competitive proposals nor will a solicitation be issued to the public. Any questions regarding this notice must be submitted in writing via email to the following point of contact or alternate point of contact no later than 2:00 PM EST on 06/4/2026.
