The contract involves the International Code Council (ICC), a nonprofit organization that develops model building codes for residential and commercial construction, which owns the copyrights to the International Codes and the International Energy Conservation Code (IECC). The agreement with the NYS Department of State (DOS) grants ICC the exclusive license to develop and distribute updated versions of the New York State (NYS) codes based on these copyrighted editions. Specifically, ICC will create an enhanced digital version of the 2024 NYS Code Books featuring advanced search, navigation, hyperlinking, annotations, and other user-friendly features, along with providing a five-year subscription to 45 designated DOS subscribers, 25 printed sets, 50 downloadable PDFs per subscriber, and hosting a public online version at no cost. The contract, awarded as a sole-source procurement due to ICC’s exclusive ownership rights, is set to last approximately five years and covers all counties in New York State, with a contract value estimated between $500,000 and $2,000,000. The agreement aims to ensure that NYS codes are updated, accessible, and compliant with current standards, supporting building safety and code enforcement throughout the state.

Full Description

ICC is a nonprofit membership association that develops model codes for construction of residential and commercial buildings.  ICC was founded in 1994 by three organizations that were then producing model building codes:  Building Officials and Code Administrators International, Inc. (“BOCA”), International Conference of Building Officials (“ICBO”) and Southern Building Code Congress International, Inc. (“SBCCI”).  In 2003, BOCA, ICBO and SBCCI formally consolidated as a single organization: the ICC. Prior to 2000, one of ICC’ founding organizations, ICBO, created a set of model building and fire prevention code publications collectively referred to as the “International Codes,” and a model building energy code referred to as the “International Energy Conservation Code” or “IECC.”   By reason of the consolidation mentioned above, ICC is sole owner of the copyright to the International Codes and the IECC. Since ICC is the sole owner of the copyright to the 2024 editions of the International Codes and the 2021 and 2024 editions of the IECC, ICC is the sole source capable of providing the required license, the subscriptions to the digital version of the 2024 NYS Code Books, the downloadable pdf versions of the 2024 NYS Code Books, the printed sets of the 2024 NYS Code Books, and the on-line version of the 2024 NYS Code Books. The agreement between DOS and the International Code Council, Inc. (ICC) will provide DOS and the Code Council with the license needed to develop (1) an amended and updated version of the NYS Uniform Code based on the copyrighted 2024 editions of the International Codes and (2) an amended and updated version of the NYS Energy Code based on the copyrighted 2021 and 2024 edition of the IECC.  In addition, the proposed agreement between DOS and ICC would require ICC (1) to create a digital version of the 2024 NYS Code Books that includes such features as enhanced search and navigation, hyperlinking, bookmarking, ability to add annotations, concurrent user functionality, color coding, and internal linking; (2) to provide a five-year subscription to the enhanced digital version of the 2024 NYS Code Books to 45 subscribers to be designated by DOS (DOS intends to designate the Division of Building Standards and Codes staff), (3) to provide 25 printed, softcover sets of the 2024 NYS Code Books to DOS, (5) to provide 50 downloadable pdf versions of the 2024 NYS Code Books for each subscriber designated by DOS, and (6) to host an online version of the 2024 NYS Code Books on ICC’s website and make that online version available to the public at no cost. Reason for advertising exemption: Single Source Award recipient: International Code Council, Inc. Any questions or comments regarding this notice of sole-source, single-source, or procurement otherwise exempt from advertising in the NYS Contract Reporter should be directed to the contact person listed for the contracting agency or public authority. Ad end date:08/15/2025 Contract term: approximately 5 years County(ies): All NYS counties
