This contract action was accomplished using other than competitive procedures because there is only one responsible source due to a unique capability provided, and no other supplies or services will satisfy agency requirements (FAR 6.302-1). See posted J&A for further information. Liebert Services, the service division of Emerson Network Power, is the only manufacturer-authorized service agent for Emerson HVAC, UPS, PDU, and SiteScan equipment. Liebert technicians are manufacturer-trained and thoroughly familiar with proprietary design of this equipment. Third-party vendors may offer to maintain this equipment, but are unable to obtain OEM equipment for repairs. Emerson does not resell its proprietary equipment (new or refurbished) to third-party agencies/organizations. Also, Liebert technicians maintain the proprietary Emerson equipment configuration management and database files which are not available to third-party vendors.
