The United States Department of Agriculture's Animal Plant Health Inspection Services intends to award a sole source, firm fixed price contract to Washington State University for the analysis of approximately 15,000 leaf samples from New York orchards to detect the Plum Pox Virus. This urgent procurement is necessary because other laboratories lack the immediate personnel, equipment, or time to process the samples before they deteriorate, which would pose a significant threat to the United States fruit industry. The action is being conducted under FAR 6.302-1 and 6.302-2 due to the compelling urgency and the fact that Washington State University is identified as the only qualified source capable of meeting the immediate requirements. The acquisition falls under NAICS code 541380 with a size standard of 12 million dollars. While this is a notice of intent for a sole source award, interested firms capable of meeting the requirements were given until August 31, 2011, to submit capability statements and three customer references to the Contracting Officer. The performance of the testing services will take place in Prosser, Washington.

Application. This authority applies in those situations where- (1) An unusual and compelling urgency precludes full and open competition; and (2) Delay in award of a contract would result in serious injury, financial or other, to the Government.
