The United States Department of Agriculture (USDA), Rural Development (RD) plans to enter into a sole source contract with the law firm Fortuño & Fortuño FAS, C.S.P., located in Guaynabo, Puerto Rico, to provide specialized legal services related to foreclosure actions, deficiency judgments, estate cases, possession recovery actions, and bankruptcy proceedings under Chapters 11 or 12. These legal services specifically pertain to Section 515 direct debts associated with two multifamily housing properties on the island of Vieques, Puerto Rico. The contract covers litigation to be conducted in local State Courts or Bankruptcy Courts where the respective properties are located, with the possibility of other courts only if directed by the Contracting Officer Representative (COR). The two properties involved are rental multi-family housing projects owned by a non-profit organization. The first property includes 53 detached units and an administration office, with a valid mortgage deed recorded, but the units are not grouped under a single project in the property registry. The second property consists of 27 apartments and an administration office, but the U.S. Government does not yet hold a perfected lien to secure its loan, necessitating corrective action to resolve registry errors that currently prevent lien perfection and recording. This is a total small business set-aside contract with award anticipated around June 17, 2014, and all inquiries are directed to Contracting Officer Antonio J. Salgado.
