AI Contract Overview
The National Institutes of Health, Office of the Director, Office of Acquisitions, is seeking to award a non-competitive, firm-fixed-price service agreement for the BD LSRFortessa flow cytometer located at the National Center for Advancing Translational Sciences in Rockville, Maryland. This acquisition is conducted under FAR Subpart 12.6 as a combined synopsis/solicitation for commercial items, utilizing the authority of FAR 6.302-3(a)(2)(ii) to justify non-competitive award due to the proprietary nature of the instrument. The LSRFortessa system is a specialized, integrated platform requiring manufacturer-specific diagnostic tools, proprietary firmware, calibrated software updates, and certified replacement parts that are exclusively available from BD Biosciences, the original equipment manufacturer. Third-party service providers lack access to essential technical documentation, calibration protocols, and inventory, making their use incompatible with maintaining instrument performance, data integrity, and warranty protections. Consequently, BD Biosciences is the only source capable of delivering comprehensive preventive and corrective maintenance, factory-trained technical support, and authorized system upgrades necessary to ensure continuous operational readiness of this critical laboratory instrument. The solicitation, numbered 75N98026Q00452, requires all responses to be submitted electronically by June 11, 2026, to the designated contract specialist, and must reference the solicitation number. Offerors must provide a detailed price quotation including unit and list prices, shipping and handling, delivery timeframe, delivery terms, F.O.B. point, and prompt payment discount terms. Manufacturers or authorized resellers must also submit product specifications, documentation proving compliance with all salient characteristics, catalog identifiers, and estimated costs. All respondents are required to be registered in SAM, provide their UEI and TIN, and submit a completed FAR 52.212-3 offeror representations and certifications form. The requirement falls under NAICS code 811210 with a 34 million small business size standard and is not set aside for small business. The contract will incorporate FAR 52.212-1 through 52.212-5 as standard commercial item clauses, and no additional terms beyond customary commercial practice are imposed. Evaluation factors include past performance, technical capability, special features, trade-in considerations, expected lifecycle, warranty, maintenance availability, and environmental efficiency, though weights are not prescribed, and the Government reserves the right to accept any offer before the deadline. The LSRFortessa system is proprietary equipment manufactured by BD Biosciences. The instrument incorporates tightly integrated optical, fluidic, electronic, and software subsystems that require manufacturer-specific diagnostic tools, calibration procedures, firmware access, and proprietary replacement parts. Preventive maintenance procedures, software updates, system calibration, and corrective repairs require factory-trained personnel with direct access to proprietary technical documentation and parts inventories.
Third-party service providers do not have access to proprietary components, firmware, software updates, engineering specifications, or specialized diagnostic equipment required to ensure proper system performance. Use of non-manufacturer service providers could compromise instrument performance, data integrity, software functionality, and system configuration, and may void existing manufacturer support protections.
BD Biosciences is the original equipment manufacturer and the only source capable of providing comprehensive maintenance, authorized software updates, certified parts replacement, and factory-trained technical support necessary to maintain the system in fully operational condition. No other source is reasonably available to meet the Government’s requirements.
(iii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (insert current circular number and date).
(iv) The associated NAICS code is 811210- Electronic and Precision Equipment Repair and Maintenance, and the small business size standard is 34 million. This requirement is not set aside for small business.
(v) Description of Requirement:
