ACTION: Notice of Intent to Award Sole Source Contract Under Unusual and Compelling Urgency

DESCRIPTION:


The Indian Health Service (IHS), Rosebud Service Unit, intends to award a firm-fixed-price sole source contract to Northern X-Ray Company (NXC Imaging) for the urgent repair of a Canon Medical 32-slice CT Scanner (Serial Number: KDA1282149) located at the Rosebud IHS Hospital, Rosebud, South Dakota.


This acquisition is being conducted under the authority of FAR 6.302-2, Unusual and Compelling Urgency, as implemented by HHS acquisition regulations and policies. Due to the urgent nature of this requirement, the Government does not have time to compete this requirement.


PURPOSE AND OBJECTIVE:


The purpose of this requirement is to restore the CT system to full operational status for clinical use. The CT scanner is essential for providing timely diagnostic imaging services, including emergency care, trauma evaluation, and critical diagnostic support for the patient population served by the Rosebud IHS Hospital.


JUSTIFICATION FOR URGENCY:


The CT scanner is currently non-operational, which significantly impairs the facility’s ability to provide critical diagnostic services. The lack of CT imaging capability poses a direct risk to patient health and safety by delaying diagnosis and treatment, particularly in emergency and life-threatening situations.


Delays associated with conducting a full and open competition would result in unacceptable interruptions to essential healthcare services. The Government must act immediately to restore the CT system to operational status to ensure continuity of care.


In accordance with FAR 6.302-2, only the minimum time necessary will be used to acquire these services on a sole source basis. Qualified service providers must have access to Canon Medical Systems USA, Inc. diagnostics to perform the most immediate and reliable repair services, including access to proprietary parts, technical data, and certified personnel necessary to expedite restoration.


EFFORTS TO OBTAIN COMPETITION:


This notice is being posted in accordance with FAR 5.201 to inform industry of the Government’s intent. The Government will consider any capability statements received; however, given the urgency of the requirement, responses must demonstrate the ability to provide immediate repair services without delay and with full compatibility with OEM specifications.


THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE QUOTES.


However, any responsible source that believes it can meet the Government’s urgent requirement may submit a capability statement.
