The US Environmental Protection Agency (EPA), Region 2 intends to issue a purchase order, on a Sole Source basis, to EarthSoft, Inc. for EQuIS software license upgrades, software maintenance and database maintenance, under the authority of FAR 6.302-1. This procurement will be in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. Quotes are not being requested and a written solicitation will not be issued. The U.S. Environmental Protection Agency collects and analyzes electronic chemistry and geological sampling data to support its remediation decisions on hazardous waste sites to ensure that they are adequately cleaned up to protect human health and the environment. In an effort to streamline the electronic submittal of environmental sampling data, the Superfund Program in EPA has adopted a standardized electronic data deliverable (EDD) format for all new and historical data submitted to the Agency, utilizing the Environmental Quality Information System (EQuIS) software package published by EarthSoft, Inc. By employing the EDD, EPA can regiment how data is transmitted to better facilitate data review and decision making. The EPA has a requirement for an Environmental Quality Information System (EQuIS) 7 Enterprise & Professional License Portfolio and EQuIS EDP License Portfolio one-year software maintenance agreement. The EQuIS license portfolio and software maintenance is limited to Earthsoft, Inc. because EQuIS is proprietary to EarthSoft, Inc.; the software is owned, authored, published and maintained by EarthSoft, Inc. only. This notice is not a request for competitive quotations. However, any firm believing it capable of meeting EPA's requirements may submit technical documentations to establish the potential of complying with the requirements. Documentation must be submitted to the point of contact within 10 calendar days of the posting of this notice. Information received will normally be considered only for the purpose of determining whether to conduct a competitive procurement or to proceed on a sole source basis. A determination not to compete this requirement based upon responses to this notice is within the discretion of the EPA.
