The United States Section of the International Boundary and Water Commission’s Falcon Field Office is planning a sole source award to Diamond Vogel for specialized paint required for the Falcon Dam spillway gates, using Simplified Acquisition Procedures under FAR Part 13 and commercial item procedures under FAR Part 12. The procurement is justified solely on the basis that Diamond Vogel’s V-766e and V-102e paint systems are the industry-standard formulations engineered to meet the U.S. Army Corps of Engineers’ Paint System No. 3 for “Impacted Immersion” environments—where steel structures endure constant submersion, high-velocity water, and debris impact. These coatings are specifically required to comply with federal standards outlined in USACE UFGS 09 97 02, and no other vendor is recognized as meeting these demanding performance criteria. The NAICS code for this requirement is 424950, with a small business size standard of 150 employees, and the product is classified under PSC 8010. This Notice of Intent is not a solicitation and does not invite competitive bids; however, interested parties may submit a capability statement and letter of interest by June 11, 2026, at 3:00 PM Mountain Standard Time, to demonstrate that competition would be advantageous to the government. All submissions must be sent via email to Angelica Baca at angelica.baca@ibwc.gov, with the exact subject line referencing the solicitation number FY263161020—Gate Painting. No telephone inquiries will be accepted, and responses must clearly and convincingly prove that competition would yield better outcomes for the government. The agency retains full discretion to proceed with the sole source award regardless of received submissions, and any information provided will be evaluated solely to determine whether to open the procurement to competition. The place of performance is Falcon Heights, Texas, and all interested parties are responsible for ensuring timely and complete submission.
