NOTICE OF INTENT TO AWARD A SOLE-SOURCE PURCHASE ORDER 


Army Contracting Command – Aberdeen Proving Ground (ACC-APG), Tobyhanna Division, Tobyhanna, PA 18466 intends to award a sole source purchase order to National Instruments Corporation, 11500 N MoPac Expy, Austin, TX 78759.


This supply requirement is for the Renewal of National Instruments (NI) Software Maintenance and Support for the following NI software at Tobyhanna Army Depot: EA Test Bundle (14 Licenses), EA Platform Bundle (3 Licenses), Calibration Executive (1 License), TestStand Base Deployment (23 Licenses).


National Instruments Corporation is the only manufacturer that can provide Enterprise Agreement software support to Tobyhanna Army Depot (TYAD). National Instruments is a proprietary software fully owned by National Instruments Corporation.  National Instruments holds copyrights, licenses, and other intellectual property rights on National Instruments software products; as such, they are the sole source to provide software support and updates to TYAD.     


The Government intends to acquire this supply under the guidelines of FAR Part 12, Acquisition of Commercial Products and Commercial Services.  The Government intends to solicit and negotiate directly with National Instruments Corporation under the authority of FAR part 6.103-1(b).


This is not a solicitation for competitive quotes. However, if any interested party that can provide this product without compromising the required criteria cited above, you may submit a statement of capabilities that may be considered by TYAD.


A determination by the Government not to compete this proposed requirement is based upon responses to this notice and it is solely within the discretion of the Government.


Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement in the future. 


The capability statement, a price list and any other information furnished must contain material in sufficient detail to allow the Government to determine if the party can meet the requirements described in this notice.
