It is the belief of the Government that this organization is the sole source to fulfill the need of one responsible source to satisfy the agency's requirement. NAG, LLC is the sole retailer for Rugged Machines and the authorized distributor for this specialized OEM equipment, which must integrate seamlessly with existing shipboard hardware developed by the Naval Surface Warfare Center – Philadelphia Division (NSWC-PD). (See attached justification [JOTFOC]).



2. Regulatory and Statutory Authority


This sole-source contracting action is conducted in accordance with Federal Acquisition Regulation (FAR) Class Deviation / Revolutionary FAR Overhaul (RFO) guidelines. Under the RFO, simplified procedures for commercial acquisitions are consolidated under RFO FAR Part 12 [specifically RFO FAR 12.201-1 (Simplified procedures) and RFO FAR 12.102(a) for acquisitions valued at or below the Simplified Acquisition Threshold]. The statutory and regulatory authorities permitting other than full and open competition are:
