The Granite School District intends to award a contract to Pearson without conducting a standard procurement process, citing Utah Code and Administrative Rules that permit such action when there is only one source for the required products or services. The district plans to purchase online and written assessments for special education and student evaluations, including products like BASC-3, Vineland-3, WISC-V, and other proprietary testing instruments. These assessments are essential tools for screening and evaluating students for special needs, and Pearson is the sole provider of these specific, nationally normed tests, which are considered technically superior for the district's purposes. The procurement is scheduled to commence as early as October 16, 2025, with an estimated annual expenditure of approximately $60,000, and the contract will extend for five years, ending in October 2030. Interested vendors who believe they can provide comparable or superior products or have valid reasons to contest the sole-source designation must submit their challenge and supporting documentation via email to the designated contact before the response deadline of October 15, 2025. The justification for this non-competitive award hinges on the uniqueness of Pearson’s products, their critical role in special education assessments, and the impracticality of alternative procurement methods under the current circumstances. The total contract value is projected to range between $500,000 and $1.5 million, reflecting the district’s long-term commitment to these assessments.

Issuing and Conducting Procurement Unit: Granite School District In accordance with Utah Code Part 63G-6a Part 8 and Utah Administrative Code R33-108, this is a notice of intent to award without engaging in a standard procurement process. It is not a request for quotes, bids or proposals. DO NOT submit questions, bids, no-bids or other information in this system. NO ACTION IS REQUIRED IF YOU AGREE WITH THIS NOTICE. If there are any other qualified vendors that meet the specifications of this notice, any such vendor must submit the following information via email only to Adar Livni at contact@example.gov prior to the event close date. The name of the contesting vendor and contact person; and a detailed explanation of the challenge, including documentation showing that there are other competing sources for the procurement item. In addition, a vendor must include: Documentation that the vendor can provide a comparable or better procurement item that meets or exceeds the specifications; documentation that the vendor can also provide the same proprietary procurement item or an equivalent procurement item; and if transitional costs are identified as the justification for this notice, submit a cost comparison of the identified transitional costs with the vendor's anticipated transitional costs. NOTICE OF INTENT TO AWARD WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Utah Procurement Code provides that a purchase may be made without engaging in a standard procurement process if it can be determined in writing that: there is only one source for the procurement item; transitional costs are a significant consideration in selecting a procurement item; or the award of a contract is under circumstances, described in rules adopted by the applicable rule making authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. Granite School District Purchasing Department has received a request to make the following award without engaging in a standard procurement process: Requesting School/Department: Special Education Product and/or service to be purchased: Online and Written Educational, Clinical, and Special Needs Student Assessments Earliest date purchase may occur: 10/16/2025 Proposed Supplier: Pearson Justification: R33-108-101a(2)(a) a procurement item for which there is no commercially available substitute, and which can be from only one vendor; NCS Pearson is the publisher and creator of the following products:
Q-Global Items, included but not limited to BASC-3, Vineland-3, KABC-II NU, Shaywitz DyslexiaScreen, WIAT-4, WISC-V, and WPPSI-IV Q-Interactive Items included but not limited to Digital Subtests and Q-Interactive License Renewals Physical Items included but not limited to CTONI-2, DAS-11, KABC-II, KTEA-3, and WNV
These products are technically superior instruments for screening students for special education and other critical assessments in the K-12 environment. This testing is the nationally normed test and is hence very useful in comparing a student's test performance to other students of the same age. Length of notice: Granite School District intends to purchase these products for the next five years, thus this notification will be considered official notification for the subsequent five years through the end of 10/16/2030. Anticipated expenditure: Approximately $60,000 annually
