Notice of Intent to Sole Source – CareWare License Maintenance Contract

This is a notice of intent for a sole-source, firm-fixed-price contract under FAR Part 13 Simplified Acquisition Procedures to continue licensing, maintenance, and 24/7/365 technical support for the Careware Nurse Self-Scheduling and Productivity System at the NIH Clinical Center in Bethesda, Maryland. The contract period spans from July 1, 2026, to June 30, 2027, and is justified solely on the grounds that Care Systems, the original developer, is the only source capable of providing the proprietary software updates, system integration, and uninterrupted support necessary to avoid operational disruption, data migration risks, and clinical workflow interference. The acquisition is not open to competition, and no solicitation or quotation will be issued, as the contracting officer has determined that only one responsible source exists under FAR 13.106-1(b)(1). All Contractor personnel must obtain and maintain an NIH Contractor Badge, complete required background checks and annual security training, and strictly comply with NIH data protection, access control, and security policies, with all data generated under the contract considered Government property. Organizational conflicts of interest must be fully disclosed and mitigated per FAR Subpart 9.5, and the Contractor is required to provide continuous technical support including federal holidays to ensure system reliability, rapid issue resolution, and sustained alignment with nursing department workflows and budgetary planning needs. Comments on the sole-source justification may be submitted via email to the Contract Specialist by May 14, 2026, at 12:00 PM EST, but no formal proposals will be accepted or evaluated.
