Introduction
This is a notice of intent, not a request for a quotation. A solicitation document will not be issued and quotations will not be requested.

Purpose
The National Institute of Standards and Technology (NIST) intends to negotiate a firm-fixed priced purchase order on a sole source basis with Exxact Corporation (UEI: ZGM8ELSJ65M3) located at 46221 Landing Parkway, Fremont, CA 94538-6407. The purchase order will be for a GPU data processing server. These products are exempt from the Buy American Act requirements of FAR RFO Part 25 as they constitute commercial information technology. Delivery will be required within 30 days after contractor receipt of order.

Authority
This acquisition is being conducted under the authority of FAR RFO Part 12.102(a) and 41 USC 1901, allowing the Contracting Officer (CO) to solicit from one source. The North American Industry Classification System (NAICS) code for this acquisition is 334111 - Electronic Computer Manufacturing with a small business size standard of 1,250 Employees.

Sole Source Determination
The sole source determination is based on the following:
 


The NIST Communications Technology Laboratory (CTL) Wireless Networks Division uses two Exxact Corporation GPU workstations to operate a research environment. The environment now must be scaled to a larger size to accommodate research activities. To maintain system reliability and compatibility of data between systems, NIST CTL now requires a third Exxact Corporation GPU. Exaact Corporation is the only manufacturer capable of providing the required GPU server configuration which includes the AMD Threadripper PRO 9975WX processor and multiple NVIDIA L40S GPUs that match existing equipment and meet the technical requirements of the ongoing research project. Therefore, Exxact Corporation-brand products are the only acceptable solution for NIST's requirements.



Exxact Corporation authorizes resellers so a competition limited to the brand name only requirement was pursued; however the results of a competitive quote evaluation in August 2026 determined that the products cannot be purchased from small business resellers at a fair and reasonable price. Quoted pricing was similar from competitive quoters and was significantly higher than purchase direct from Exxact Corporation. The competitive small business price quotes were determined to not be fair and reasonable. Therefore, a sole source to Exxact Corporation is the only appropriate sourcing strategy to procure the required products at a fair and reasonable price.
