On October 29, 2024, the New York State Office of the State Comptroller approved a single-source exemption for the New York State Department of Transportation (NYSDOT) to continue providing the State Safety Oversight Program for Rail Transit Agencies across all counties in New York State. This exemption allows NYSDOT to avoid competitive bidding due to the impracticality of such a process given the scope of work and cost considerations, as justified under NY State Finance Law Section 163.10 (b). The contract, which spans from March 1, 2023, to February 28, 2026, was awarded to Vital Assurance, Ltd., and the exemption was granted to facilitate ongoing oversight activities without interruption. The contract's value is estimated to be between 5 million and 15 million dollars, emphasizing its significant scope and statewide impact. The procurement process was posted publicly with a response deadline of November 7, 2024, and inquiries regarding the sole-source award are directed to Shalina Mallory at the NYSDOT. The program aims to enhance safety oversight for rail transit agencies, ensuring compliance and safety standards across New York State’s extensive transit network. This exemption underscores the importance of maintaining specialized oversight services through a trusted provider without the delays associated with competitive procurement, thereby supporting the continued safety and efficiency of rail transit operations statewide.
