The U.S. Section of the International Boundary and Water Commission has awarded a non-competitive, fixed-price bridge contract to Veolia Water North America – West, LLC for the 24/7 operation and maintenance of the South Bay International Wastewater Treatment Plant in San Diego, California. This sole-source action was executed under FAR 6.302-1, as the incumbent is the only responsible source capable of maintaining uninterrupted services at this critical infrastructure facility. The bridge contract was necessitated by the cancellation of a previous competitive solicitation due to material deficiencies in the Performance Work Statement and a significant undisclosed organizational conflict of interest. The primary objective of this limited-duration agreement is to prevent environmental, public health, and treaty-compliance failures while the government completes a new competitive procurement process. The period of performance runs from April 1, 2026, through March 31, 2027, with an additional two-month option period ending May 31, 2027, to facilitate a seamless transition to a successor contractor. Key requirements include maintaining National Pollutant Discharge Elimination System permit compliance and protecting the Tijuana River watershed. Performance is based on the incumbent's site-specific expertise and trained workforce to ensure no degradation of mission-essential wastewater services.

(Fixed‑Price, Not Competitively Awarded, Includes Transition Options)

This contract action was not awarded competitively, but it is a fixed‑price contract. In accordance with FAR 6.302‑1, Only One Responsible Source, the U.S. Section of the International Boundary and Water Commission (USIBWC) determined in a formal Determination & Findings that only the incumbent, Veolia Water North America – West, LLC, could provide uninterrupted Operations & Maintenance (O&M) services at the South Bay International Wastewater Treatment Plant (SBIWTP) during the required acquisition corrective‑action period. The plant is a 24/7 critical‑infrastructure facility where any operational lapse would result in immediate environmental, public‑health, regulatory, and treaty‑compliance impacts.

The prior competitive solicitation (No. 191BWC26R0001) was canceled due to material deficiencies in the PWS, ambiguous requirements, and a significant undisclosed organizational conflict of interest (OCI), requiring a full re‑solicitation under a defensible competitive process.

The Government requires the full contract period to properly complete the next competitive procurement to be awarded upon the conclusion of this action.

The period of performance for this sole‑source contract is April 1, 2026 through March 31, 2027, with an additional two‑month option period (April 1, 2027 through May 31, 2027) to support transition to a newly‑awarded competitive successor contract if required.

These transition CLINs ensure continuity of operations and prevent degradation of mission‑essential wastewater treatment services during contractor turnover.

This limited‑duration, sole‑source, fixed‑price bridge action is required solely to maintain uninterrupted operations while the Government prepares, competes, and awards the upcoming full and open long‑term O&M contract.

The period of performance is up to six months, with work typically aligned to the non-irrigational season between October and February. Retamal Dam Buoy System
Solicitation # 191BWC26R0006
The International Boundary and Water Commission (IBWC) is soliciting a firm-fixed-price design-build contract for the Retamal Dam Buoy System in Hidalgo County, Texas. The project aims to establish a new waterway barrier line featuring anchors, an alert system, and warning signs to prevent public access to dangerous hydraulics and reduce structural impacts from debris. The scope is divided into two phases: the preparation of design documents and the subsequent construction and commissioning of the system. The estimated project magnitude is between 5 million and 10 million dollars, with a total performance period of 485 calendar days from the notice to proceed. The procurement follows a two-phase design-build selection procedure under FAR Subpart 36.3, where award is based on a rational tradeoff between cost and non-price evaluation factors, including technical plans, past performance, and financial condition. Bidders must meet strict qualification requirements, including the submission of IBWC Form 245 and evidence of professional licensure for design engineers. Site access is restricted to specific working hours, and contractors must coordinate with Border Patrol and avoid US Fish and Wildlife property. Proposals must be submitted exclusively via a secure SharePoint portal by the extended deadline of September 16, 2026.
