The Internal Revenue Service (IRS) on behalf of the Department of the Treasury intends to issue a sole source firm-fixed price purchase order, on the basis of only one responsible source, for the purchase of software maintenance for its current OPNET software licenses. The period of performance will be December 15, 2012 - December 14, 2013. This purchase order will be made on a sole source basis under the authority of FAR Part 6.302-1 (a) - only one responsible source and no other supplies or services will satisfy agency requirements. The Government anticipates the value of the award to be $42,288.96. Justification for other than full and open competition - Only One Source Rationale: "The Department of the Treasury's Departmental Offices (DO) is seeking to renew its hardware & software maintenance and support of its current OPNET licenses. This maintenance and support offers solutions for application and network performance management. OPNET Maintenance will address hardware & software defects, failures, replacements and technical support hours 24x7x365. OPNET Software will address: application performance management, network performance management, and network R&D. OPNET Solutions will deliver broad visibility, monitoring across infrastructure domains, deep data collection and analytics to enable powerful root cause diagnosis. This procurement will continue the current maintenance support and software license agreements currently owned by the Treasury/DO/OCIO. OPNET is the only available source for the software maintenance and support of OPNET software licenses. This is because OPNET does not have any authorized resellers for software maintenance and support. OPNET only allows resellers to sell the initial licenses to the Government. It does not allow resellers to sell/provide the software & hardware maintenance and support. OPNET sent a letter to the CO via email on 10/09/2012 stating that it does not have any authorized resellers for software & hardware maintenance and support." The Department of the Treasury has identified OPNET Technologies, Inc as the sole source for software maintenance on OPNET software licenses. The notice will of intent to award to OPNET Technologies, Inc will be posted on FedBizOpps in accordance with FAR 5.2. The Contracting Officer will determine the costs to the Government to be fair and reasonable. Market research was conducted and it was determined that only OPNET can perform the required work as it is the only source for the hardware and software maintenance and support. GSAAdvantage! and DOD's Software Application Systems were searched and no other resellers were found. OPNET sent a letter to the CO via email on 10/09/2012 stating that it does not have any authorized resellers for software maintenance. No sources expressed, in writing, an interest in the acquisition. The Government will continue to search the market place for solutions that will meet the Government's needs. However, the Government will continue to search for other authorized resellers of OPNET's software maintenance for future procurements. The Contracting officer certifies that the justification is accurate and complete to the best of the contracting officer's knowledge and belief. Any other responsible sources who believe they can provide the required products and service may submit a written capability statement, via email, by 10 am ET on December 10, 2012. Telephone inquiries will be considered non-responsive. No solicitation will be issued, therefore, requests for solicitations will be considered non-responsive. If no responses are received the award will be made to OPNET Technologies, Inc.
