AI Contract Overview

The Florida School for the Deaf and the Blind (FSDB) has officially canceled the solicitation for high voltage electrical maintenance services, originally posted under RFP number 24-099. The decision was made after it was determined that only one or fewer responsive bids were received, which is below the statutory threshold of two bids required for a competitive process. In accordance with Section 2.26 of the solicitation document and Florida Statutes § 287.057(6), FSDB reserves the right to reject all responses or withdraw the solicitation at any time if it is deemed in the best interest of the state. Given the limited responses and the resource-intensive nature of re-soliciting under the same specifications, FSDB has opted to negotiate directly to establish the best terms and conditions for the required services, thereby avoiding the need for a new solicitation process. All inquiries regarding this cancellation should be directed via email to Kim Whitwam or Sharon Pennant, the designated contacts for the project. The primary contact for questions is Sharon Pennant, reachable at [email hidden] or by phone at [phone hidden]. The decision underscores FSDB’s commitment to efficient resource use and timely project completion, prioritizing the best interests of the institution and the state of Florida.

Section 2.26 of the Solicitation Document enumerates FSDB’s Reserved Rights. Specifically, 2.26.2 reserves the right to reject all replies at any time, including after an award is made when doing wo would be in the best interest of the State of Florida, and by doing so, assumes no liability to any Vendor. Section 2.26.1 reserves the right to withdraw the solicitation at any time, including after an award is made when doing so would be in the best interest of the State of Florida, and by doing so, assumes no liability to any Vendor.Additionally, Florida Statutes § 287.057(6) provides that if less than two responsive bids or proposals are received in response to a solicitation, the Agency may negotiate the best terms and conditions in the "best interest of the state" in lieu of re-soliciting the service. After advertising the Competitive Solicitation package referenced above, we received less than two responses to the solicitation announcement. Because it is time and resource intensive to conduct a competitive bid process and we have already conducted that process, to re-solicit this project with the same specifications and requirements would require the same amount of resources and time and would likely yield the same result – receiving less than two responses. Moreover, due to the time requirements of completing the project with minimal disruption to student services and the business of FSDB, it is determined that it is in the best interest of the State of Florida and Florida School for the Deaf and the Blind to negotiate the best terms and conditions for the provision of the products/services specified in the referenced solicitation, which is hereby withdrawn/cancelled.At this time, it has been determined that it is in the best interest of the State of Florida and FSDB to withdraw/cancel the subject solicitation.Primary Contact: Please submit all questions by e-mail to: Kim Whitwam, Director of Purchasing, contact@example.gov or Sharon Pennant, Contract Administrator contact@example.gov .
