The Department of Corrections and Community Supervision is extending a one-year public performance license contract with Swank Motion Pictures, Inc., covering all correctional facilities across New York State. This license permits the department to legally show motion pictures to incarcerated individuals, ensuring compliance with Federal Copyright Laws and avoiding substantial fines associated with unauthorized public performances. The contract, originally awarded as a single-source procurement, spans from April 1, 2019, to March 31, 2025, with the current extension valid until May 29, 2024. The license is essential for the department to operate within legal parameters when providing entertainment in correctional settings, which are classified as public performances under copyright law. This agreement encompasses 44 correctional facilities throughout New York State, with a contract value estimated between $50,000 and $150,000. The procurement process was conducted as a sole-source award due to Swank Motion Pictures, Inc., being the designated provider for this service. Any inquiries related to this contract or the sole-source exemption should be directed to the appropriate contact within the agency. The contract supports the department’s efforts to offer recreational programming while maintaining legal compliance and avoiding penalties for copyright infringement.
