The proposed action involves the purchase and supply of 32 flush valves for the Rockford Courthouse, 327 S. Church Street, Rockford, Illinois (Stanley J. Roszkowski US Federal Courthouse). The proposed action will be accomplished pursuant to FAR 6.302-2, because of tenants moving into the building and a need for the flush valves to work as soon as possible. 1. FAR 5.202(a)(2) does not require that the action be synopsized. 2. 41 U.S.C. 253 (c)(2)permits agency to limit the number of sources from which it solicits bids or proposals. Description of services required. Purchase, supply and install 32 flush valves. The estimated value of this procurement is $8,641.99. Identification of statutory authority. FAR 6.302-2 Unusual and Compelling Urgency, 41 U.S.C. 253(c)(2). Demonstration that the acquisition requires use of the authority cited. The work is necessary because the new tenants need to be able to flush the toilets. Description of efforts to solicit as many offers as practicable. A competitively awarded contract is not feasible due time restraints. Demonstration that the anticipated cost will be fair and reasonable. A Government Cost Estimate was prepared for this location, and will be used to determine the fair and reasonableness of the offer. Description of the market survey conducted. N/A Other facts supporting the use of other than full and open competition. None other than those indicated above. Statement of actions to overcome barriers to competition. The contractor is the Operations and Maintenance for the building and is knowledgeable of the system, the building and the equipment locations and can complete the work without disruptions to the tenants or the building. Given the circumstances of this situation, there are no actions that could be taken to remove or overcome the existing barriers to competition. The need to acquire the stated service in the manner proposed is due to the need for accomplishing the service in as short a period of time.
