Legal, Nonconforming Case No. 2, Map 167Kern County is seeking consideration for vested mining rights concerning approximately 206 acres adjacent to the existing Monolith Limestone Quarry, located within an A Exclusive Agriculture zoning district. This request pertains to Legal, Nonconforming Case No. 2, Map 167, and involves the potential continuation of mining operations on land that currently does not conform to agricultural zoning regulations due to prior vested rights. The project area lies near Tehachapi, California, and the initiative is driven by Tehachapi Cement, LLC and UNACEM North America, the property owners, who are working in coordination with Kern County’s planning department to address regulatory and environmental compliance issues related to the expansion or continuation of historic mining activities. The primary point of contact for this matter is Randall P. Cates, Planner III at Kern County, who can be reached through official county channels. Additional support and environmental coordination are provided by the environmental departments of Tehachapi Cement, LLC and UNACEM North America. Although this is a forecasted action with no formal solicitation number or NAICS classification, it signals an early-stage regulatory review aimed at validating longstanding mining rights that predate current land use restrictions. The project’s progress will likely involve environmental assessments and public review processes, as indicated by its presence on the CEQA Net portal, suggesting that compliance with California environmental law will be central to any approval.

Solicitation # 1927-ITP-2024-083-06
The California Department of Fish and Wildlife has issued an incidental take permit to Mitsubishi Cement Corporation for the Cushenbury Mine Project, authorizing the incidental take of 2,896 western Joshua trees as a result of mining operations on approximately 278.2 acres in San Bernardino County. Activities include clearing, grading, excavation, vegetation removal, road construction, blasting, and eventual reclamation, supported by both temporary and permanent haul roads. The permit is issued under Section 1927.3 of the Fish and Game Code and aligns with the Western Joshua Tree Conservation Act and the California Endangered Species Act, ensuring compliance with legal protections for the threatened species. Mitigation and conservation measures are required to offset the impact of tree loss, with ongoing monitoring and reclamation efforts mandated as part of the permit conditions. Contract administration and oversight are managed by the California Department of Fish and Wildlife in coordination with San Bernardino County officials, with point of contact provided for environmental and planning inquiries.
