The Health Resources & Services Administration (HRSA) plans to negotiate directly with the National Kidney Foundation (NKF) of New York and the National Donor Family Council (NDFC) to support the planning and execution of services related to the tenth National Donor Recognition Ceremony and Workshops. Due to the confidentiality protections under the National Organ Transplant Act, the government does not have access to donor identities or contact information. As a result, NKF is uniquely positioned to provide access to organ and tissue donor families, facilitate communication about the event, and offer sensitive support, given their specialized experience working with donor families, living donors, and recipients. This exclusive access and expertise justify a sole source contract to avoid duplicative efforts and excessive costs that would arise if other entities had to replicate past work, in accordance with federal acquisition regulations. This procurement is not a competitive solicitation but rather a notification of HRSA’s intent to contract with NKF/NDFC under the authority permitting other than full and open competition. The need for this direct award is further supported by a formal justification on file, emphasizing that NKF/NDFC is the only responsible source capable of meeting the unique requirements of this project. The contracting officers involved are Michael S. Herbst and Francis R. Murphy, and the action is referenced under solicitation number 06-N234-5531mh. The focus of the work aligns with NAICS code 541618, covering management consulting services relevant to the event’s planning and implementation.

Full Description

The Health Resources & Services Administration (HRSA intends to negotiate- on a sole source basis'with National Kidney Foundation(NKF) of New York, National Donor Family Council(NDFC), New York. The purpose of this requirement is to assist the Division of Transplantation (DoT), Health Systems Bureau with the planning and implementation of meeting services and activities related to the tenth National Donor Recognition Ceremony and Workshops. Because the National Organ Transplant Act protects the confidentiality of donors, the Government has no access to the identities of the Nation's donors and no contact information for them. It is critical therefore for NKF to assist the Division of Transplantation (DoT) with the implementation of the 2007 NDRCW to have access to the identity of and contact information for organ and tissue donor families across the country in order to provide them information about, and registration information for, the event. Especially because many of the attending families tend to be fairly early in their grief process, the contractor also must have considerable experience in working with donor families, living donors, and recipients, and understanding their special needs. Any other source would have to duplicate a substantial array of current and previous efforts to accomplish the same objectives if the law allowed access to donor information. This would cause substantial duplication of cost, which would not be expected to be recovered through competition. Therefore, NK/NDFC is determined to be the only responsible source under the authority found in 41 USC 253(i), as set forth in FAR 6.302-1(a) (2). This is not a solicitation, but a notification of our intent to contract. A justification for other than full and open competition (JOFOC) is on file. See Note 22
