AI Contract Overview

The National Institutes of Health (NIH) intends to negotiate sole source contract modifications with several law firms to extend existing patent legal services contracts by five months, from June 14, 2007, through November 13, 2007. This extension increases the total contract ceiling price and ensures continuity of essential patent-related services including patent searches, prosecution, infringement and interference services, as well as licensing consultation for the NIH’s Office of Technology Transfer. The firms involved are established legal service providers located across various cities in the United States, and the extension is necessary to avoid any lapse in service while new contracts are being negotiated and awarded under a competitive solicitation process. This action is taken under FAR 6.302-1 authority because it is impracticable to seek competition for the short extension period during ongoing negotiations for the new contract under RFP #263-2006-P(GM)-0247. A service interruption would pose significant risk to the protection of U.S. intellectual property rights across multiple patent cases domestically and internationally. The notice clarifies that this is not a request for proposals and that no solicitation document will be issued. Inquiries may be directed to the designated NIH contract specialist, Erin Flynn.
