The Rational Requisite Pro and SODA Float Licenses and Maintenance and Support contract is a hybrid Fixed Price and Time and Materials Indefinite Delivery Indefinite Quantity agreement. While the primary scope covers streamlined standard upgrades and maintenance, the contract includes a 500,000 dollar IDIQ line item to accommodate unpredictable future needs such as emergency maintenance, software training, and project or report conversions. Because the full extent and duration of these additional tasks cannot be accurately estimated, the government opted against a cost-reimbursement model in favor of task orders based on negotiated, fully burdened hourly rates. Under this arrangement, emergency maintenance will be handled as Labor Hour tasks, while other IDIQ tasks may be fixed-price. The contract anticipates associated costs for labor and materials related to migration and conversion efforts. Performance and surveillance of the contractor's work will be managed by the Contracting Officer's Technical Representative. This award was managed by the FDA under solicitation number 10-223-SOL-00051 with NAICS code 541511.

Full Description

The Requisite Pro and SODA License Support and Maintenance contract is a hybrid Fixed Price / Time and Materials Indefinite Delivery Indefinite Quantity (IDIQ) contract. Most of the work to be performed is streamlined and consists of standard upgrades and maintenance. But, due to a potential future need to receive training on the new acquired software, emergency maintenance, and conversion of several projects / reports FDA has determined that it is in the best interest of the Government to incorporate an IDIQ line item in the amount of $500,000 that T&M task orders may be placed against. FINDINGS 1. At this time, it is not possible to estimate accurately the extent or duration of the work, or of the anticipated costs, for the additional Requisite Pro related tasks with any degree of confidence. 2. Several of the IDIQ tasks may be fixed-price but the emergency maintenance tasks will be Labor Hour. 3. A cost-reimbursement contract would be unacceptable as the program office is unable to accurately describe the majority of the work to be performed, unable to estimate the costs up front and, consequently, unable to evaluate a cost proposal. 4. Services will be provided by the contractor utilizing the services of negotiated labor categories at specific fixed hourly rates. The hourly rates are fully burdened. 5. The Government anticipates materials and labor costs to be associated with some of the additional maintenance, conversion, and migration efforts. 6. Government surveillance of contractor work / performance will be by the Contracting Officer's Technical Representative (COTR).
