The Environmental Protection Agency is issuing a work assignment amendment under existing contract EP-W-08-073 for the Leaking Underground Storage Tank project at the former Mobil Oil site in Batesland, South Dakota, located on the Pine Ridge Indian Reservation. This action obligates 62,178 dollars in Recovery funding to conduct a site assessment involving the advancement and sampling of up to eight soil borings and the subsequent conversion of those borings into groundwater monitoring wells to delineate contamination. Groundwater samples will be collected from all monitoring wells that do not contain free product. This opportunity is restricted to the current USEPA Region 8 contractor and is not open for new bids. The funding is provided through the American Recovery and Reinvestment Act, and the agency has determined that utilizing existing Office of Underground Storage Tank contracts is the most efficient method to meet the act's requirements and time constraints. All work will be performed under the oversight of the Headquarters Acquisition Division to ensure economical performance and risk mitigation.

THIS NOTICE IS PROVIDED FOR INFORMATION PURPOSES ONLY. THIS OPPORTUNITY WAS AVAILABLE ONLY TO THE USEPA REGION 8 CONTRACTOR UNDER CONTRACT EP-W-08-073. REQUESTS AND/OR INQUIRIES WILL NOT BE ADDRESSED. IT IS THE INTENT OF THE USEPA TO APPROVE A WORK ASSIGNMENT UNDER AN EXISTING CONTRACT. The purpose of this announcement is to proclaim that the Work Assignment Amendment is to obligate a total of $62,178 in Recovery funding to perform this requirement at the site. The site assessment shall consist of the advancement and sampling of up to eight soil borings, and the conversion of the borings to groundwater monitoring wells to further delineate soil and groundwater contamination at this site. Groundwater samples shall be collected from all site monitoring wells that do not have free product present. The site is located on the Pine Ridge Indian Reservation in Batesland, South Dakota. The American Recovery and Reinvestment Act (ARRA) contains specific acquisition requirements that must be met when using appropriated funds from the Act, including the need for acquisitions to be in accordance with the FAR and, to the maximum extent practicable, awarded as fixed-price (FP) contracts using competitive procedures. However, the Office of Management and Budget's guidance allows for the use of other than FP contracts. Although the Agency's Office of Underground Storage Tank (OUST) contracts were not awarded as FP contracts, each contract structure was selected to provide the contractor with the greatest incentive for efficient and economical performance, given the types of services to be performed. The existing OUST contracts have sufficient qualified acquisition personnel to provide appropriate contract administration and oversight to monitor contract performance to mitigate the Government's risk. In order to meet the requirements of the Act in the most prudent business manner within the time constraints imposed, existing OUST contracts are the most appropriate contractual vehicles consistent with Agency plans that promote the goals of the ARRA. THIS NOTICE IS PROVIDED FOR INFORMATION PURPOSES ONLY THIS REQUIREMENT IS TO BE AWARDED TO AN EXISTING EPA CONTRACTHOLDER. REQUESTS AND/OR INQUIRIES WILL NOT BE ANSWERED.
