S10948 Honolulu Harbor, Piers 52-53, Repair Trench Drains, Oahu, Hawaii The scope of work consists of repairing trench drains at Piers 52-53 at Honolulu Harbor, Oahu, Hawaii. To be eligible for award, bidders shall possess a valid State of Hawaii General Engineering Contractor's "A" license at the time of the bid opening and maintain the license during the course of the contract. HRS-§444-9 makes it unlawful for any person to act or advertise as a contractor (general engineering, general building, or specialty) without first obtaining a proper license in accordance with Chapter 444 (Hawaii Contractors Licensing Law.) PRIME CONTRACTORS MUST HOLD THE PROPER LICENSE. A prime contractor cannot “borrow” or rely on a subcontractor’s license to meet licensing requirements. Each contracting entity is responsible for being licensed for the scope of work it will perform. If a project’s scope calls for a General Engineering Contractor “A” license in Hawaii, the prime contractor on that job must personally hold an “A” General Engineering Contractor license – simply subcontracting portions of the work to licensed subcontractors does not make an unlicensed prime into a licensed general contractor. Chapter 444 does not contain any provision that would allow an unlicensed firm to operate under another company’s license; in fact, the law prohibits such arrangements. Contract Start and End Date shown in the HIePRO solicitation are estimates. The exact dates shall be provided by written notice from the Harbors Construction Engineer.
